<br />ORDINANCE NO. 623 <br />PUBLIC HEARING <br />CONTINUED <br /> <br />January 16, 1979 <br />Minutes - page 20 <br /> <br />The point was made that the agricultural zone is an <br />overly restrictive zone. <br />I think that is certainly a debateable question in <br />that it is overly restrictive in normal residential <br />zoning, our smallest single family lot size that they <br />are applying for is 7,000 feet. We have other zones <br />which permit 12,000 square foot lots and 20,000 <br />minimum square foot lots; but in terms of an open <br />space buffer, I don't believe that one unit per 5 <br />acres, particularly if clustered, is overly re- <br />strictive at all. <br /> <br />The adjacent zoning of the area around the site <br />and the Lafayette zoning was pointed out. I think <br />if one carries that to its ultimate conclusion, then <br />there would be no way to ever stop development <br />because always there is going to be a zone adjacent <br />to open space and vice versa somewhere, or it is <br />going to be adjacent to some other city or the <br />county or something, but there has to be a line <br />drawn somewhere and I don't believe the fact that <br />Lafayette has zoning which permits 1 dwelling unit <br />per 3,000 square feet right north of the site is <br />the basis to lead this City to do anything. <br />Lafayette has violated the open space buffer on <br />several, has violated several times and I don't <br />think that's justification to violate it as well. <br /> <br />The cost of utilities for 5 acre lots was pointed <br />out. <br />Again I believe the opportunity to use the Planned <br />Unit Development provisions of our zoning ordinance <br />which would allow the clustering of these houses <br />would provide for the reasonable economic development <br />of the site. <br /> <br />The statement was made by Mr. Porter that the City <br />directed the annexation and zoning and that it was <br />temporary. <br />The statement was made and I am trying to quote, but <br />this may not be precise and if we have to play back <br />the tape we can. <br />When Mr. Caranci was asked the question What did Mr. <br />Wurl say, or something of that effect, referring to <br />what was Mr. Wurl saying to the development group <br />that; and I am taking this out of context, that Mr. <br />Wurl said that they could, that they should zone it <br />agricultural now that will make it easier at this <br />time and that they could come into the City for <br />rezoning. <br />Well, I think that is an accurate assessment of the <br />situation. That statement itself does not say that <br />anyone said that it would be rezoned, because I don't <br /> <br />know how a City staff person could say that when the <br />
