ORDINANCE NO. 623 PUBLIC HEARING CONTINUED January 16, 1979 Minutes - page 22 out to me on the comprehensive plan map, what area this City has annexed and rezoned for urban de- velopment that is in the open space area shown on our comp plan. I don't believe there is any; and I think that's an important distinction between this rezoning application and other development proposals this City has received. Se have not received de- velopment proposals that proposed development of open space areas. They have all been on this plan or on that colored plan in the areas designated for deve lopmen t . In conclusion I would like to state the staff re- commendation. I would strongly urge the City Council to deny this rezoning application. That recommendation is based on the obvious conflict a conflict which is in a particularly sensitive area as relates to Lafayette; and I believe that granting such rezoning would be in violation with the comprehensive plan and that violation could result in the city's of Lafayette and Louisville ultimately growing together, developing right up next to each other because at that point in time neither City will be recognizing the open space buffer I think that will result in some loss of community identity of Louisville. It will cer- tainly result in the loss of a potential open space recreation area, and I think perhaps mostly importantly at this time in the City's growth and development, that violation of our plan will result in the loss of credibility of the Louisville Coun- cil in its support of open space and its over all approach to growth. There are alot of things happen- ing today. I think that we've had support of other agencies because Louisville has indicated a commit- ment to its comp plan and support of that comp plan. I think that if we violate the comp plan that that credibility will be lost and we will be open to criticism in many other areas. The recommendation is also based on the fact that the rezoning would be in violation of the declaration of policy for rezoning provision of the zoning ord- inance in our municipal code and lastly the Planning Commission recommended denial of this re- zoning and I think Council always considers the re- commendation of the Planning Commission. That is all I have.
