<br />ORDINANCE NO. 623 <br />PUBLIC HEARING <br />CONTINUED <br /> <br />January 16, 1979 <br />Minutes - page 22 <br /> <br />out to me on the comprehensive plan map, what area <br />this City has annexed and rezoned for urban de- <br />velopment that is in the open space area shown on <br />our comp plan. I don't believe there is any; and <br />I think that's an important distinction between this <br />rezoning application and other development proposals <br />this City has received. Se have not received de- <br />velopment proposals that proposed development of <br />open space areas. They have all been on this plan <br />or on that colored plan in the areas designated for <br />deve lopmen t . <br />In conclusion I would like to state the staff re- <br />commendation. I would strongly urge the City <br />Council to deny this rezoning application. That <br />recommendation is based on the obvious conflict <br />a conflict which is in a particularly sensitive area <br />as relates to Lafayette; and I believe that <br />granting such rezoning would be in violation with <br />the comprehensive plan and that violation could <br />result in the city's of Lafayette and Louisville <br />ultimately growing together, developing right up <br />next to each other because at that point in time <br />neither City will be recognizing the open space <br />buffer I think that will result in some loss of <br />community identity of Louisville. It will cer- <br />tainly result in the loss of a potential open <br />space recreation area, and I think perhaps mostly <br />importantly at this time in the City's growth and <br />development, that violation of our plan will result <br />in the loss of credibility of the Louisville Coun- <br />cil in its support of open space and its over all <br />approach to growth. There are alot of things happen- <br />ing today. I think that we've had support of other <br />agencies because Louisville has indicated a commit- <br />ment to its comp plan and support of that comp plan. <br />I think that if we violate the comp plan that that <br />credibility will be lost and we will be open to <br />criticism in many other areas. <br /> <br />The recommendation is also based on the fact that <br />the rezoning would be in violation of the declaration <br />of policy for rezoning provision of the zoning ord- <br />inance in our municipal code and lastly the <br />Planning Commission recommended denial of this re- <br />zoning and I think Council always considers the re- <br />commendation of the Planning Commission. <br /> <br />That is all I have. <br />
