Minutes - page 6 October 17, 1978 RESOLUTION NO. 34 TRACK INN SPECIAL USE REVIEW Mayor Waschak stated that he had re- ceived a telephone call from Mrs. Rose Garcia who requested that he inform Council of her feelings against the request. Mr. Richard Merciez spoke against the request. He stated that the language is loud and obscene and did not want to add to the problem. After Council comments Councilman DiCarlo moved that Resolution No. 34, Series 1978, disapproving the Beer Garden be adopted. Seconded by Coun- cilman Kilker. Attorney Joss read Resolution No. 34, disapproving the Beer Garden. Councilman DelPizzo moved to amend the motion that the matter be tabled. There was no second, therefore the Mayor declared the motion dead. Roll call vote was then taken on the adoption of Resolution No. 34. DiCarlo yes, DelPizzo yes, Berry yes, Meier no, Kilker yes. Motion carried. RESOLUTION NO. 35 COAL CREEK DEVELOPMENT FILING NO. 2 Attorney Joss read Resolution No. 35, Series 1978, Bill Arnold, gave a brief summary of their plans and offered to answer ques- tions. It was noted that the sidewalks in the plans had been agreed upon by the de- veloper and the City. Mr. Drumm stated that the box cars will be individually sold as in town houses. Councilman Meier moved that Resolution No. 35, Series 1978, approving the Coal Creek Station Filing #2 Subdivison Plat, be adopted. Seconded by Councilman DelPizzo. Motion carried. Councilman DiCarlo moved that_the City Attorney's report be accepted and placed on file. Seconded by Councilman Meier. Motion carried.
