LL City0f CITY COUNCIL COMMUNICATION <br />Louisville AGENDA ITEM 3 <br />COLORADO • SINCE 1878 <br />SUBJECT: DISCUSSION/DIRECTION/ACTION — PROCESS TO FILL CITY <br />COUNCIL VACANCY <br />DATE: DECEMBER 14, 2022 <br />PRESENTED BY: MEREDYTH MUTH, CITY CLERK <br />SUMMARY: <br />The City Clerk has received a letter of resignation from Mayor Stolzmann indicating that <br />her last day will be January 10, 2023 allowing her to take office as Boulder County <br />Commissioner. This will leave the Mayor's position vacant. Per the City Charter, the City <br />Council, by a majority vote of the remaining members, shall appoint a person who <br />meets the qualifications to hold the office. That appointee will hold the position until a <br />mayor is elected and takes office in November 2023. <br />If a vacancy for the position of Mayor occurs, the City Council may appoint an existing <br />Councilmember to fill the seat or appoint any qualified resident to the seat. If the Council <br />appoints an existing member to serve as Mayor, the Council will then appoint a qualified <br />resident to fill the vacant Council seat. That person would hold the office until the <br />November 2023 election. <br />Anyone who wants to fill a vacancy must meet the following requirements: <br />• For a mayoral vacancy: reside in the City and have done so for a minimum of 12 <br />months <br />For a council vacancy: reside in the current boundaries of the Ward of the vacant <br />seat and have done so for a minimum of 12 months <br />MTI i <br />• Be a citizen of the United States <br />• Be at least 18 years of age <br />• Be a registered elector <br />Councilmembers will first have to decide if they wish to appoint a mayor from within the <br />Council or not; once that decision is made, an application process can begin. <br />Staff has prepared a draft application for the process based on the application used in <br />2019. It includes questions the Council chose in 2019 which can be updated. Council <br />may consider appointing a committee to write new application questions. <br />The City Charter does not give a specific timeline to fill the vacancy. Given the quickly <br />approaching holiday season and the busy Council meeting schedule, staff suggests the <br />CITY COUNCIL COMMUNICATION <br />39 <br />
