This structural damage <br />would be confirmed with a licensed structural engineer." He still believes that the term <br />damaged is too broad and not defined clearly enough. He wonders if they should be <br />more specific with that word. He mentions that how it is written now does not include <br />language that says it has to be structurally damaged. <br />Brauneis says that the condition could also just be that staff needs to create the <br />language to better define what damaged entails. <br />Howe says he does not think there is a need for the condition. He does think that how it <br />is written, there leaves room for ambiguity for what a destroyed structure means. <br />Brauneis mentions that the condition could be that staff addresses the definition of <br />damaged before it is presented to City Council. <br />Howe says he thinks it should be defined a little bit. He does believe it should <br />encompass people who have significant damage but he does not know how that would <br />be written. <br />Brauneis says the condition they make could say that staff addresses the definition of <br />damaged in advance of bringing it to City Council. <br />Zuccaro wonders if the distinction for damaged could reference back to if the house <br />has to be rebuild outside of the envelope of the house. If you just need to drywall or <br />insulate, you do not need to change the envelope of the house. If you have to tear out <br />an exterior wall or the entire house, that is when it has significant damage. <br />Brauneis says we could do that or just create a condition that requests that staff <br />addresses that. He asks if Commissioner Howe is comfortable with a condition like that. <br />Howe says he is and that it satisfies his concerns. <br />Howe moves and Diehl seconds a motion to approve Resolution No. 2, Series 2022 <br />with two conditions. The first being that city staff addresses the damaged qualifications <br />mentioned in this ordinance. Secondly, city staff will examine the potential for sunsetting <br />different aspects of the ordinance. Motion passes unanimously by a roll call vote. <br />ELECTION OF CHAIR, VICE CHAIR, AND SECRETARY <br />Brauneis describes the election positions and opens the discussion for nominees. <br />Moline says if Brauneis is willing to be chair and Hoefner to be vice chair, he nominates <br />them for those positions. <br />Diehl expresses his interest in the role of secretary. <br />Moline says he would be happy to nominate Diehl as secretary. <br />Moline moves and Diehl seconds a motion to elect Brauneis as Chair, Hoefner as Vice <br />Chair, and Diehl as Secretary. Motion passes unanimously by a roll call vote. <br />NEW BUSINESS — PUBLIC HEARING ITEMS <br />B. Extension of the Approval of The Terraces on Main PUD: A request for a three <br />year extension of The Terraces on Main Planned Unit Development to allow for a <br />22,020 square foot commercial building and 5,802 square foot parking garage at 712 <br />and 722 Main Street. (Resolution No. 3, Series 2022). <br />• Applicant: Hartronft Associates <br />• Case Planner: Lisa Ritchie, Principal Planner <br />All notice was met as required and there is no commissioner conflict of interest. <br />
