RESOLUTION NO. 13 <br />SERIES 2022 <br />A RESOLUTION RECOMMENDING DENIAL OF THE REDTAIL RIDGE FILING NO. 1 <br />PRELIMINARY AND FINAL SUBDIVISION PLAT <br />WHEREAS, the City of Louisville is a home rule municipal corporation organized <br />under and pursuant to Article XX of the Colorado Constitution and the Home Rule <br />Charter; and <br />WHEREAS, by virtue of such authority, and as further authorized by state <br />statutes, including but not limited to C.R.S. § 31-23-201, et seq., and C.R.S. § 29-20- <br />101, et seq., the City has broad authority to make and adopt a comprehensive plan for <br />the physical development of the municipality and regulate the subdivision of land; and <br />WHEREAS, the City's duly -adopted subdivision regulations are set forth in Title <br />16 of the Louisville Municipal Code; and <br />WHEREAS, on April 6, 2010, by Ordinance 1569, Series 2010 (Reception No. <br />03284515), the City rezoned the property known as the ConocoPhillips Campus <br />property to Planned Community Zone District — Commercial (PCZD-C), approved the <br />ConocoPhillips Campus General Development Plan (Reception No. 3088779) (the <br />"GDP"), and on April 20, 2010 executed the Planned Community Zone District Zoning <br />Agreement for such GDP (Reception No. 03284516; and <br />WHEREAS, the applicant, Sterling Bay, has submitted to the City an application <br />for approval of the Redtail Ridge Filing No. 1 Preliminary and Final Subdivision Plat to <br />develop the ConocoPhillips Campus property as a commercial development consistent <br />with the ConocoPhillips Campus General Development Plan (the "Application"); and <br />WHEREAS, the Planning Commission has considered the Application at a duly <br />noticed public hearing held on August 11, 2022, September 8, 2022, and September 22, <br />2022 where evidence and testimony where entered into the record; and <br />WHEREAS, after consideration of the evidence and testimony presented at the <br />public hearing and based on the following findings, the Planning Commission directed <br />City staff to draft a resolution recommending the City Council deny the Application. <br />NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION <br />OF THE CITY OF LOUISVILLE, COLORADO: <br />Section 1. The foregoing recitals are incorporated into this Resolution by this <br />reference. <br />Section 2.
