Case No. 08-025-FP/FS <br /> <br /> Applicant, Owner and Representative: Acme Terrace, LLC – Garrett Mundelein <br /> <br /> Case Manager: Sean McCartney, Principal Planner & Paul Wood, Planning Director <br />Public Notice Certification: <br />Published the Camera on May 31, 2009 Posted in City Hall, Public Library, <br />Recreation Center and Courts and Police Building and mailed to surrounding <br />property owners on May 29, 2009. <br />Conflict of Interest and Disclosure: <br />None heard. <br />Staff Report of Facts and Issues: <br /> Wood provided the following summary: <br /> <br /> Request for a final subdivision plat and final planned unit development <br />(PUD) of approximately one acre in area for five single family homes <br />and ten townhome units on three parcels (561, 557 and 555 County <br />Road. <br /> <br /> Located south of downtown Louisville on the southwest corner of <br />County Road and Elm Street. <br /> <br /> Property is zoned RM and is subject to the Old Town Overlay District. <br />Wood continued with a summary of the Planning Commission preliminary review <br />process for the property on October 9, 2008 which forwarded a recommendation <br />to City Council. City Council passed a motion (6 to 1) on November 3, 2008 to <br />approve the preliminary plat and PUD with conditions. <br />Wood stated the applicant, Garrett Mundelein, is requesting final authorization of <br />the required land-use entitlements to plat three ownership parcels into a six lot <br />subdivision for residential development. <br />Wood continued with a review of the City Council conditions of approval and how <br />the applicant had addressed those conditions. <br />1. The Subdivider to fully comply with a public use dedication as set forth in <br />Section 16.16.060 of the Louisville Subdivision Code with an agreement <br />The <br />resolving the land dedication issue to be in place at final platting – <br />City Staff and the applicant continue to work on this issue and will <br />address it in the subdivision agreement. <br />2. The PUD shall be modified to reduce the number of proposed dwelling <br />units from 16 to 15 units to be consistent with the underlying zoning <br />The overall density of the final PUD <br />requirements for the entire site – <br />has been reduced to 15 units; 10 townhome units and 5 single family <br />homes. <br /> <br />3. The subdivision plat shall be revised to reflect the alley right-of-way <br />dedication by outlot. The conveyance of the right-of-way shall establish a <br />minimum alley width of 20’ for the full length of the property backing up to <br /> <br />
