Outlot A will be dedicated to the City for right-of-way
purposes providing a continuous alley width of 20’.
4. In accordance with the provisions of the Floodplain Development Permit,
the lowest habitable floor elevation shall be certified at an elevation of
5,332. Elevation certificates shall be submitted for each dwelling unit prior
The condition will be
to the issuance of a certificate of occupancy –
addressed at the time of building permit in accordance with FEMA
elevation certificate requirements.
5. The applicant shall coordinate with the City Forester to establish a
minimum setback around the existing Silver Maple Tree and incorporate
The applicant has
that requirement on the final PUD landscape plan –
made all efforts to work with the City Forester in retaining the
existing Silver Maple. This effort has been reflected in the final PUD
landscape plan.

6. The requested variances for height limit (to 30 feet) and FAR (for .42 FAR)
The City Council conditioned their
shall be applicable to Lot 4 only –
approval of the preliminary PUD on a maximum net Floor Area Ratio
of .42 (13,380 sf) specifically for Lot 4, which had a lot area of 31,857
square feet. The lot area of Lot 4 has been reduced on the final plat
and PUD to 25,959. Therefore, as the area of Lot 4 has been
decreased there is a corresponding decrease in the permitted FAR.
The maximum .42 net FAR on Lot 4 has been decreased from 13,380
square feet based upon the former lot area of 31,857 square feet, to a
net FAR of 10,903 based upon the revised lot area of 25,959 square
feet. As shown below the applicant is requesting a total square
footage of 11,700 square feet resulting in an FAR of .45, an increase
of 797 square feet.

Lot# Lot Size OTO Lot Proposed OTO .42 Proposed Proposed
Coverage Lot FAR FAR Gross FAR Net FAR
.30 Coverage .35 .68 .45
4 25,959 7,788 6,858 SF 9,086 10,903 17,694 SF 11,700
SF

It should be noted that the distinction created between gross and net
FAR is based upon the preliminary assumption that Lot 4 is in the
100 year regulatory floodplain. The first floor garages may function
for parking, but may not be converted to habitable space. The first
floor garages have been netted out of the gross FAR. The maximum
.42 FAR allows the applicant to develop a total of 10,903 square feet
on Lot 4. Therefore, the proposed Lot 4 net FAR of 11,700 square feet
on the final PUD does not comply with the .42 net FAR established
on the preliminary PUD.
