City Council <br />Meeting Minutes <br />September 6, 2022 <br />Page 5 of 13 <br />Public Comments — None. <br />Councilmember Dickinson suggested this amendment to section 17.16.120(E) "If a <br />Planned Unit Development requires a fence constructed of wood or another <br />combustible material, a property owner may install a non-combustible fence for the <br />portion of the fence that connects the principal structure to the side property line. <br />Mayor Stolzmann closed the public hearing. <br />MOTION: Councilmember Dickinson moved to approve the ordinance as amended; <br />Councilmember Brown seconded. <br />VOTE: Motion carried by unanimous roll call vote <br />ORDINANCE NO. 1839, SERIES 2022 — AN ORDINANCE AMENDING CHAPTER <br />17.76 OF THE LOUISVILLE MUNICIPAL CODE REGARDING INCLUSIONARY <br />HOUSING REQUIREMENTS — PUBLIC HEARING (advertised Daily Camera 8/7/22) <br />Mayor Stolzmann introduced the item and asked for disclosures; seeing none she <br />opened the public hearing. <br />Manager Ritchie stated that in 2018, the City endorsed the Boulder County Regional <br />Housing Partnership Regional Housing Strategy which adopted a goal of 12% <br />permanently affordable housing in Boulder County by 2035. In June 2021, Council <br />adopted an ordinance that requires a minimum of 12% of all new housing be deed <br />restricted for affordable housing. The ordinance also offered options of a fee -in -lieu, <br />acquiring off -site affordable housing, dedicate land in lieu of providing affordable <br />housing or entering into an alternative agreement that provides equivalent affordable <br />housing. <br />In August 2021, Council discussed possible incentive options that could increase <br />affordable housing. As a result, a draft ordinance is being presented which requires <br />30% inclusionary housing when a property is rezoned from a non-residential zone <br />district to one that allows residential uses. The requirement for affordable housing would <br />also apply to properties with residential uses approved through a Special Review Use, <br />and to a General Development Plan or General Development Plan amendment with <br />residential uses. It removes the fee -in -lieu option and requires on -site units. Approval of <br />the ordinance does not change any existing Comprehensive Plan and Small Area Plan <br />policies. <br />Planning Commission does recommend approval of the ordinance with the condition for <br />further analysis on the feasibility of the 30% requirement and consideration of additional <br />incentives for developers. <br />
