DocuSign Envelope ID: F97554E0-E2BC-4D6B-9851-2FC0172606EE <br />INTERGOVERNMENTAL AGREEMENT <br />THIS INTERGOVERNMENTAL AGREEMENT (the "Agreement") is entered into this <br />15 day of March, 2023, by and among the Board of County Commissioners on behalf of the County <br />of Boulder, State of Colorado, a body corporate and politic, for the benefit of the Boulder County <br />Clerk and Recorder (the "Clerk"), the City of Louisville, a Colorado municipal corporation whose <br />address is 749 Main Street, Louisville, CO 80027 (the "City"); and the Louisville Fire Protection <br />District (the "District"). The Clerk, the City, and the District may be collectively referred to as the <br />"Parties." <br />WHEREAS, the Clerk and the City entered into an Intergovernmental Agreement ("IGA") <br />on May 4, 2021, which allowed the Clerk to install a mail ballot drop-off box at the Louisville <br />Recreation Center (the "Property"), which is owned by the City, and to use and have access to the <br />City's video surveillance recording system at the Property to monitor the mail ballot drop-off box; <br />and <br />WHEREAS, the Clerk has funded the entire cost of obtaining, installing, and maintaining <br />the mail ballot drop-off box since that time, and the Clerk controls the mail ballot drop-off box; <br />and <br />WHEREAS, the City controls the video security surveillance recoding system on the <br />Property; and <br />WHEREAS, the District is conducting an election on May 2, 2023 (the "Election") and <br />wishes to use the mail ballot drop-off box and video security surveillance recording system during <br />the Election to provide a convenient location for District voters to drop off their completed mail <br />ballots (the "Purpose"); and <br />WHEREAS, the Clerk wishes to authorize use of the mail ballot drop-off box to the District <br />during the Election; and <br />WHEREAS, the City wishes to authorize use of the video surveillance recording system to <br />the District during the Election; and <br />WHEREAS, intergovernmental agreements are authorized and encouraged by Article XIV, <br />Section 18 of the Colorado Constitution and COLO. REV. STAT. 5 29-1-203. <br />NOW, THEREFORE, in consideration of the recitals, promises, covenants and <br />understandings set forth herein, the Parties agree as follows: <br />1. Term of Aueement. The term of this agreement is March 14, 2023 to May 10, 2023 <br />(the "Term"). <br />2. Existing IGA. This Agreement stands apart from the May 4, 2021, Intergovernmental <br />Agreement between the Clerk and the City. It does not replace or amend the IGA. <br />
