Motion <br />carried. <br /> <br />There were no comments from the audience. <br /> <br />Attorney Joss reported that hopefully the <br />Mayhoffer suit is settled by his de- <br />livery of the City check in the amount of <br />$14,025.00 for the land and 3 additional <br />checks for commissioners fees. The clerk <br />of court delivered these checks and Judge <br />Neighbors ordered that the findings of <br />the commissioners be entered as final <br />order of the court, and the money be <br />disbursed to Mrs. Mayhoffer and the com- <br />missioners. <br />Colorado Appraisal Service was also issued <br />a check in the amount of $300 for their <br />pretrial preparation in regard to this <br />suit. <br />Attorney Schroeder's letter, which was <br />given to Council indicated the pretrial <br />conference has been set for Nov. 1, 1977. <br />Before trial date can be set a pretrial <br />conference is held with the Judge and <br />attorney's. At this time we are still <br />waiting for a date to be set for taking <br />depositions of the plaintiffs. <br /> <br />A meeting had been scheduled with the <br />officials of HUD January 28, 1977. Be- <br />cause of a conflict with the LURA staff <br />the meeting was rescheduled for Thrusday <br />February 3, 1977, at 10:00 A.M. <br />Mr. Dave Chenoweth is planning to attend <br />with the City Attorney. <br />Councilman DiCArlo asked Attorney Joss, <br />if for some reason, Mr. Chenoweth is un- <br />able to make the February 3rd meeting would <br />it still be held. <br />Attorney Joss stated that the meeting would <br />still be held. <br /> <br />Councilman Domenico moved that the City <br />Attorney report be accepted and placed <br />on file. Seconded by Councilman DiLorenzo. <br />Motion carried. <br /> <br />Mr. Wurl stated that after reviewing the <br />Public Service Franchise the problem still <br />in question was the favored nation's <br />clause, and that would be the entire State <br />of Colorado; in the franchise this was <br /> <br />-4- <br />
