TRAINOR CONSTRUCTION CONT'D AUDIENCE COMMENTS CITY ATTORNEY MAYHOFFER SUIT PIERCE SUIT COMMUNITY DEVELOPMENT REORGANIZATION CITY ADMINISTRATOR REPORT PUBLIC SERVICE FRANCHISE Seconded by Councilman DelPizzo. Motion carried. There were no comments from the audience. Attorney Joss reported that hopefully the Mayhoffer suit is settled by his de- livery of the City check in the amount of $14,025.00 for the land and 3 additional checks for commissioners fees. The clerk of court delivered these checks and Judge Neighbors ordered that the findings of the commissioners be entered as final order of the court, and the money be disbursed to Mrs. Mayhoffer and the com- missioners. Colorado Appraisal Service was also issued a check in the amount of $300 for their pretrial preparation in regard to this suit. Attorney Schroeder's letter, which was given to Council indicated the pretrial conference has been set for Nov. 1, 1977. Before trial date can be set a pretrial conference is held with the Judge and attorney's. At this time we are still waiting for a date to be set for taking depositions of the plaintiffs. A meeting had been scheduled with the officials of HUD January 28, 1977. Be- cause of a conflict with the LURA staff the meeting was rescheduled for Thrusday February 3, 1977, at 10:00 A.M. Mr. Dave Chenoweth is planning to attend with the City Attorney. Councilman DiCArlo asked Attorney Joss, if for some reason, Mr. Chenoweth is un- able to make the February 3rd meeting would it still be held. Attorney Joss stated that the meeting would still be held. Councilman Domenico moved that the City Attorney report be accepted and placed on file. Seconded by Councilman DiLorenzo. Motion carried. Mr. Wurl stated that after reviewing the Public Service Franchise the problem still in question was the favored nation's clause, and that would be the entire State of Colorado; in the franchise this was -4-
