<br />CTC CONT'D <br /> <br />reflects that the annexation is complete <br />but still in the process of the annexation <br />and zoning. <br />After the presentation Mayor Waschak <br />opened the matter for public hearing. <br />There were no comments from the audience. <br />The public hearing was closed and dis- <br />cussion was turned over to Council. <br />Engineer White read Resolution #15 per <br />taining to the CTC Development plan. <br />Mr. Mizel noted in the Resolution that <br />the Boulder County Land Venture was not <br />included as one of the co-developers in <br />the Resolution. Correction made. <br />Mr. Drumm stated that the plan has pre- <br />viously been submitted to Council for <br />review in that manner. <br />Councilman Caranci moved that Resolution <br />#15, Series 1976, be adopted as modified <br />including the Boulder County Land Venture <br />as a co-developer. Seconded by Councilman <br />McDonald. <br />Roll call vote. Domenico yes, McDonald <br />yes, Caranci yes, DiLorenzo yes, DiCarlo <br />yes. Motion carried. <br /> <br />RESOLUTION #15 <br />CTC <br /> <br />APPROVAL OF ANNEXATION <br />AGREEMENT <br /> <br />Mr. Wurl stated that the action required <br />on the agreement is acception and autho- <br />rization of the Mayor to sign the agree- <br />ment. Councilman Domenico moved that the <br />Aneexation Agreement be adopted and the <br />Mayor be authorized to sign the Annexation <br />Agreement between the developer and the <br />City of Louisville. Seconded by Council- <br />man DiCarlo. <br />Councilman Caranci stated that on the <br />water line it notes that any tap ons will <br />have a rebate to the developer for the cost <br />of the line. <br />He felt that there should be a time limit <br />of so many years in which to do this be- <br />cause, should the pipe need to be replaced <br />and is done so by the City, then it should <br />be back in the Citys hands. <br />Mr. Mizel stated that the only problem with <br />that is that it is not certain when the <br />pipe will be put in. He also stated <br />that the rebate charge will be over and <br />above the tap fee charge. <br />Mr. Wurl stated that the problem is that <br />once the City accepts maintenance of the <br />line, if it ever needs to be replaced the <br />City will do it at no cost to anyone. <br /> <br />9. <br />
