<br />CTC CONT'D <br /> <br />Mr. Mizel stated that the rate imposed by <br />the developer will not interfere with the <br />City fee; and that the deal was that the <br />developer had the right to recapture <br />costs and nothing more. <br />Mr. Mizel stated that at this time he did <br />not have any other answer in regards to <br />the water line. He felt that later on, <br />after developement begins, the matter can <br />be better discussed. <br />Mr. Conarroe asked what the modifications <br />were in the Annexation Agreement. <br />Mr. Wurl stated that the modifications <br />were the additions that the LUC wanted. <br />Mr. Houlehan stated that phrases as "If <br />annexation should occur" are no longer <br />in the agreement due to annexation. <br />He staed that one inclusion that the LUC <br />requested was that it be noted in the <br />agreement that future Councils will not <br />be bound. <br />Councilman McDonald asked about the <br />sanitation facilities, if the City is <br />binding themselves to meet the demands of <br />the developer. <br />Mr. Wurl stated that the City is binding <br />themselves as to meet the requirements <br />of the developement. The City is not <br />only bound by the agreement but by the <br />EPA County and State Health Departments. <br />Mr. Wurl stated that the expansion is <br />right in the program, Stage I has been <br />complete, Stage II has begun. <br />Councilman Caranci asked about the binding <br />of the developer to construct a lift <br />station within the agreement <br />Mr. Wurl read a portion of the agreement <br />as pertained to the proper sewage facilities <br />required by the developer. <br />Attorney Morris stated that he felt this <br />would be sufficient wording. <br />Councilman Caranci stated that he would <br />like to see "including lift station if <br />necessary" noted in the agreement. <br />Mr. Mizel stated that he would see no <br />problem with that. <br />Mr. Houlehan stated that he would like <br />to see the wording as before because if <br />it is possible to obtain a grant, this <br />type of wording in the agreement may be <br />cause for losing the grant. <br />Mr. Wurl stated that then again, if the <br />wording is included, it may be beneficial. <br />It was agreed that the wording "Including <br />lift station if necessary" would be <br /> <br />10. <br />
