Authority Report 2008 (cont.) <br />The Authority re- visited the issue of increasing fees in 2008. The State passed legislation in <br />2007 allowing an increase in application fees which the Authority chose not to institute at the <br />time. Now, with the increased staff and legal time spent on new licenses and Special Events <br />Permits, we saw a need for an increase in new license application fees and special events <br />permit application fees. An ordinance was drafted and ultimately adopted by Council in 2008. <br />Suspected liquor code violations continue to be reviewed on an individual basis by the Authority <br />as incidents occur. Several incidents were reviewed and determined to require no further action <br />by the Authority. The Authority continues to encourage license holders to appear before the <br />Authority to discuss questions and concerns either the licensee or the Authority might have and <br />what can be done to avoid problems. <br />The Authority issued a total of three Show Cause Orders in 2008. Outside counsel was <br />necessary to represent the City's interest at the Show Cause Hearings. Attorney Stefan <br />Fredericksmeyer represented the Authority in these hearings. The Show Cause Orders resulted <br />in the following actions: <br />ATTEST: <br />1) The Back Room: Charged with Serving a Visibly Intoxicated Person and Conduct of the <br />Establishment. The special prosecutor moved there was insufficient evidence to charge <br />the establishment with the first charge and the Authority found the second charge was <br />supported. This resulted in a 7 day suspension. <br />2) The Back Room: Charged with Serving a Visibly Intoxicated Person. Authority found <br />there was sufficient evidence to support the charge and it resulted in a 21 day suspension <br />with 7 days held in abeyance to run concurrently with the previous suspension. <br />3) The Back Room: Charged with Serving a Visibly Intoxicated Person. The Authority <br />found sufficient evidence to support the charges and gave 35 days suspension with 21 <br />days held in abeyance. <br />It should also be noted the Authority sent letters of appreciation to Chili's for the way they <br />handled an incident with an intoxicated person and to Henry's Bar and Grill for reporting a <br />disturbance.
