WATER & SANITATION
AGREEMENT CONTID

Mr. Mizel remarked that he has documents
showing the water acquisitions that were
purchased with the properties and that he
will be doing everything possible to
obtain water as the City does not have to
provide water to the development until they
have it.
Councilman DiCarlo stated that he would not
like to see the City in a position of
having to buy shares from parties who
may be holding back now and then con-
fronting the City at a later date.
Mr. Mizel stated that these rights are
agricultural rights and the usage will have
to be changed and it may be practical to
buy rights from ther sources to provide
adequate water needed over the years.
He stated that all he has acquired has been
turned over to the City.
Mr. Wurl stated that he has acquired a list
from Farmers R & I Co. on the amounts of
rights owned by individuals and the difficult
part is trying to isolate how much water
went with a specific piece of property.
Mr. Mizel stated that he di buy all shares
which were available to him. He also
stated that they would work with the
City in any way to obtain available water
shares.
Council stated that they would like to
have the agreement revised and brought be-
fore them before they took any action on it.
Mr. James Kirksphalen, from the LUC
addressed Council stating their thanks to
the City of Louisville for their cooperation
and that the LUC is taking no position on
the agreement and have no plans for chal-
lenging it since their concerns have
been taken care of. He stated that they
will not get involved on the proposed
annexation or service agreement.

Councilman Domenico moved that an adjourned
meeting be scheduled for January 21, 1976,
to discuss the agreement.
