<br />WATER & SANITATION <br />AGREEMENT CONTID <br /> <br />Mr. Mizel remarked that he has documents <br />showing the water acquisitions that were <br />purchased with the properties and that he <br />will be doing everything possible to <br />obtain water as the City does not have to <br />provide water to the development until they <br />have it. <br />Councilman DiCarlo stated that he would not <br />like to see the City in a position of <br />having to buy shares from parties who <br />may be holding back now and then con- <br />fronting the City at a later date. <br />Mr. Mizel stated that these rights are <br />agricultural rights and the usage will have <br />to be changed and it may be practical to <br />buy rights from ther sources to provide <br />adequate water needed over the years. <br />He stated that all he has acquired has been <br />turned over to the City. <br />Mr. Wurl stated that he has acquired a list <br />from Farmers R & I Co. on the amounts of <br />rights owned by individuals and the difficult <br />part is trying to isolate how much water <br />went with a specific piece of property. <br />Mr. Mizel stated that he di buy all shares <br />which were available to him. He also <br />stated that they would work with the <br />City in any way to obtain available water <br />shares. <br />Council stated that they would like to <br />have the agreement revised and brought be- <br />fore them before they took any action on it. <br />Mr. James Kirksphalen, from the LUC <br />addressed Council stating their thanks to <br />the City of Louisville for their cooperation <br />and that the LUC is taking no position on <br />the agreement and have no plans for chal- <br />lenging it since their concerns have <br />been taken care of. He stated that they <br />will not get involved on the proposed <br />annexation or service agreement. <br /> <br />Councilman Domenico moved that an adjourned <br />meeting be scheduled for January 21, 1976, <br />to discuss the agreement. Seconded by Coun- <br />cilman DiCarlo. Roll call. Caranci no, <br />DelPizzo no, DiCarlo no, DiLorenzo no, <br />McDonald no, Domenico yes. Motion defeated. <br /> <br />Councilman Caranci then moved that the <br />agreement be returned to the City staff and <br />Mr. Mizels staff for revision then returned <br />to Council by January 22, 1976 for their <br />review; and that a adjourned meeting be <br />scheduled for January 27, 1976, at 7:30 P.M. <br />in the City of Louisville Council Chambers, <br /> <br />-7- <br />
