WHEREAS, it will be necessary for the City Clerk to purchase services and equipment for the recall election in a timely and expedient manner in order to comply with the statutory deadlines for the election; and WHEREAS, Section VII of the City's Purchasing Policies authorize the waiver of formal and informal bidding procedures in emergency situations, which are defined to include situations where any department's operations may be severely hampered; and WHEREAS, given the short time frame in which the election must be conducted, the proximity of the recall election to the November 7, 2023 coordinated election, and the limited number of vendors available to provide equipment and services for the election, the City Council finds it appropriate to authorize the City Clerk to utilize the emergency purchasing procedures if necessary. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. A recall election is hereby ordered to be held October 3, 2023 to submit to a vote of the registered electors of Ward 2 the question of whether Maxine Most shall be recalled from the office of Louisville City Councilmember (Ward 2). 2. Such election shall be held as a mail ballot election pursuant to the Colorado Municipal Election Code of 1965, as amended. 3. Candidates to succeed Councilmember Most, if recalled, may be nominated on petition forms provided by the City Clerk beginning on July 12, 2023. Signed nomination petitions must be submitted to the City Clerk by July 31, 2023. 4. The City Clerk shall have the authority to contract for the necessary equipment and supplies to conduct the recall election in an amount not to exceed $50,000. The City Clerk is further authorized to utilize the emergency purchasing procedures set forth in Section VII of the City's Purchasing Policies if necessary. 5. The City Clerk is hereby authorized to appoint election judges for the October 3, 2023 recall election in accordance with the Colorado Revised Statutes. The appointed election judges will receive $19.46/hour for their services. 6. The officers and employees of the City are hereby authorized and directed to take all necessary and appropriate actions to effectuate the provisions of this Resolution in accordance with Colorado law.
