Local Licensing Authority <br />Meeting Minutes <br />May 22, 2023 <br />Page 3 of 6 <br />Machado called for any changes to the consent agenda. Seeing none, <br />Carlson moved the items on the consent agenda be approved; <br />Kaufman seconded. All in favor. <br />7. Authority Business <br />A. Public Hearing: Renewal Application for Louisville Watering <br />Hole, Inc. d/b/a DJS Watering Hole — Hotel & Restaurant Liquor <br />License — 988 West Dillon Road <br />The Public Hearing was opened by Machado. Adam Gollin, Special <br />Prosecutor for the City, introduced himself. Jatin Patel, owner of DJS <br />Watering Hole introduced himself. <br />Mr. Gollin offered exhibits that were marked and provided to the <br />Authority prior to the start of the hearing. Mr. Gollin made his opening <br />statement, acknowledging that returns and payment made on May 17, <br />2023. However, due to the form of payment the City is not sure the <br />payment has "cleared" until 5-7 days after the payment is made. <br />Mr. Patel made his opening statement indicating that there was a <br />misunderstanding and he believed that the restaurant's point of sale <br />system was paying the sales tax to the City. <br />Mr. Gollin called the City's Finance Director, Ryder Bailey, for <br />questioning regarding the history of the sales tax account for DJS <br />Watering Hole. Mr. Patel did not have any questions for Mr. Bailey. <br />Mr. Patel was sworn in and testified that they thought the point of sale <br />system was dispersing the taxes appropriately. Once they were aware <br />of the issue they did make efforts to file the returns and pay the taxes. <br />Mr. Gollin did not have any questions of Mr. Patel. <br />Authority members did not have any questions of either witness. <br />Mr. Gollin made a closing statement suggesting that the license could <br />be renewed with the condition that the payment "clear", or other <br />conditions such as review of the account in six months. <br />Mr. Patel made a closing statement expressing concern regarding <br />certain conditions. <br />Machado closed the public hearing. Kaufman asked for clarification <br />from Mr. Patel regarding timing of notification of not paying sales taxes <br />and submission of returns and payment of back taxes. Mr. Patel <br />explained the delay as confusion on the part of the owners and the <br />issue with their accountant being busy with the federal tax time. <br />
