<br />City Council <br />Meeting Minutes <br />June 16, 2009 <br />Page 5 of 8 <br /> <br />DISCUSSION/DIRECTION - PROPOSED CHARTER AMENDMENTS <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />City Manager Fleming reviewed three charter amendments proposed by Staff for <br />the November ballot. Each amendment would help in the day-to-day activities of <br />the City and clarify the existin~l Charter language. In order to meet the deadlines <br />of the election calendar and place this on the November ballot, an ordinance <br />must be brought before Council for first reading on July 7, and second reading on <br />July 21. The proposed amendments are as follows: <br /> <br />1. Scaling back of the restrictions in Section 12-4 regarding lease purchases. <br />The elimination or change in this section would allow for lease of office <br />equipment and other materials. It may also help with certain solar/green <br />options on City projects. <br /> <br />2. The addition of language to Section 4-2 (c), which requires Special <br />Meeting notices be hand-delivered to City Council members. Staff <br />recommended the addition to the existing Charter language: "The meeting <br />notice required in Subsection (a) and (b) shall be served personally or <br />sent by electronic mail to the member's e-mail address, or left at the <br />member's usual place of residence. <br /> <br />3. Clarification of Section 4-3 regarding Study Sessions. The requirements <br />are imposed upon a "public body," with "public body" defined as boards, <br />commissions, task forces and committees, with the express inclusion of <br />City Council. An amendment to the language will clarify this point and <br />include a City Council requirement to meet the Study Session guidelines. <br /> <br />COUNCIL COMMENT <br /> <br />Councilor Muckle asked if a lease/purchase agreement requires a non- <br />emergency ordinance. City Attorney Light confirmed Title 1 of the state statutes <br />requires a non-emergency ordinance. He suggested the Charter reflect the <br />requirement and any changes to the statute. <br /> <br />Councilor Muckle requested Council confirmation on the receipt of notice. <br />Councilor Yarnell questioned such confirmation and the consequences for non- <br />compliance. Councilor Dalton agreed and felt the current notice is appropriate. <br /> <br />Mayor Sisk and Councilor Sackett voiced their support for change of notice and <br />the lease/purchase amendment. <br /> <br />Councilor Muckle requested the state requirement for lease approval through a <br />non-emergency ordinance be incorporated into the charter amendment. <br />
