ENGINEERING CONTRACT ROCKY MOUNTAIN CONSULTANTS FLEMING CONSTRUCTION PAYMENT Mr. Wurl stated that the proposed eng- ineering contract has been submitted from Rocky Mountain Consultants relating to the engineering and consulting of the water tank at the filter plant. Mr. Wurl stated that he and Engineer White have gone over the contract several times making needed changes and recommended that Council approve the contract being discussed. The cost of the engineering was in the amount of $42,500. Council felt that the cost was high and also that they did not feel it was right to have the penalty clause for the con- sultant and not the City. Mr. Wurl stated that the firm would be asked to put in a penalty clause for the City. Mr. Wurl stated that the tank proposed has a 2~ million gallon capacity and it can easily be changed to 3 million as the City has funds to cover the cost of a larger tank. After discussion on the contract and the proposed tank, Councilman Berry moved that the Mayor and City Clerk be authorized to sign the contract between the City and Rocky Mountain Consultants. Seconded by Councilwoman Dhieux. Roll call. Domenico no, Caranci yes, Dhieux yes, DiCarlo no, DelPizzo yes, Berry yes. Motion carried. Mr. Wurl also stated that with this con- tract the Engineer has the right to ter- minate the contract for the City if he feels that the contracted engineers are not doing a good job. Mr. Wurl stated that the payment is a retainer which was left from the fire house and some work done during the moving of the City garage in a total amount of $360.90. Councilman DiCarlo moved that Fleming Construction bill in the amount of $360.90 be approved. Se- conded by Councilwoman Dhieux. Roll call.
