<br />HB 1041 - MATTERS OF STATE <br />INTEREST cont'd <br /> <br />FLOOD HAZARD AREAS <br /> <br />MAJOR EXTENSION OF EXISTING <br />WATER & SEWAGE TREATMENT SYSTEMS <br /> <br />ARTICLE 13 <br />ZONING ORDINACE <br /> <br />He felt that mineral deposits should not be <br />of significant value based on the information <br />of today. <br /> <br />Mr. Drumm read the amendment to the plan as <br />prepared for the Planning Commission. (See <br />attached Resolution #5 & Comprehensive Plan <br />Flood Hazard Area Amendment). He stated that <br />the amendment was adopted by Resolution by <br />the Planning Commission. <br /> <br />Mr. Drumm stated that the modifications have <br />been made as accurately as possible and that <br />the Soil Concervation Service (SCS) is pre- <br />paring a detailed study. He stated that the <br />stated flood areas are the best guide to <br />flood hazards at this time. He stated that the <br />City has a flood plain ordinance and that you <br />can not control outside your corporate limits <br />with HB 1041 any more then with the Flood <br />Plain Ordinance. Under clarification Mr. <br />Drumm stated that the City has an adequate <br />ordinance to rule development in these area; <br />and that the areas be identified by the Plan- <br />ning Commission as an area of state interest <br />and that Council not designate it. <br /> <br />Councilman Berry asked Mr. Drumm if the City <br />delineates the flood hazard areas through <br />man made restrictions, the flood area could <br />possibility change. Under the conservation <br />service would the City be allowed to do this <br />in the future if the becomes possible. <br />Mr. Drumm believed what would come out of the <br />SCS study is the flooding as it now occurs. <br />~e stated that it would be possible to delin- <br />eate flood areas. <br /> <br />Mr. Drumm stated that the amendment as pre- <br />pared for Planning Commission was adopted by <br />them as modified. (See attached Resolution <br />#6 & Treatment Systems Amendment) <br />Mr. Conarroe asked if these as modified were <br />meeting the state requirements. <br />Mr. Bucknam stated that the guidelines pre- <br />pared by LUC is a first draft and undergoing <br />revision. He stated that the guidelines pre- <br />by the City and LUC have very minor differences. <br /> <br />Mr. Drumm stated that article 13 is a proposed <br />article to the zoning ordinance to provide for <br />the administrative guidelines and regulations <br />for regularion of geologic hazard areas. The <br />staff proposes that these guidelines be in- <br />cluded in the zoning ordinance to prevent <br /> <br />6. <br />
