<br />HB 1041 - MATTERS OF STATE <br />INTEREST cont'd <br /> <br />MINERAL RESOURCES <br /> <br />Councilwoman Dhieux asked why the City should <br />have to follow someone elses ideas which have <br />not been proven when the City could probably <br />design their own hazard area from past know- <br />ledge from local citizens that have worked <br />the areas underground and why would the state <br />not accept this. <br />Mr. Shelton stated that he would recommend <br />that the areas of mining be looked at and see <br />what potential there is for the City growing <br />in that direction; then if the City needs to <br />go in the direction of an old mine he would <br />encourage getting as much input as possible <br />from local citizens to find out what subsidence <br />hazards are and where they would locate them. <br />Councilwoman Dhieux stated that from looking <br />at the map she could not see any possible <br />growth because of the hazard areas. <br />Mr. Shelton stated that the City could plan <br />their hazard map, but as a geologist and mem- <br />ber of the CGS the state would object to the <br />map if the undermined areas were not included. <br />Mrs. Mary Dilorenzo stated that she spoke with <br />a miner recently and he stated that he was <br />almost positive that there would be no sub- <br />sidence on the Mizel land. <br /> <br />Mr. Hobbs again stated that he would like to <br />have the City requeste detailed studies on <br />the proposed land development before being <br />annexed. <br /> <br />Mr. Drumm read the amendment as prepared for <br />the Planning Commission. (See attached <br />Resolution #4 & Mineral Resource Amendment) <br /> <br />Mr. Drumm pointed out that identified areas <br />the overlay map are subject to reclassification <br />should studies prove different. <br />Mr. Drumm reviewed the map on mineral resource <br />areas. He stated that again Sproul property <br />was excluded because of the Robinson & Assoc. <br />study. Areas outside of that land and along <br />Coal Creek are designated as mineral resource <br />areas. He stated that because of HB 1529 <br />requirements the City should regulate these <br />areas through that instead of through HB 1041. <br />He stated that the staff is proposing that <br />mineral resources not be designated. It has <br />been identified by amending the plan. <br />Mr. Drumm stated that sand and gravel are the <br />main minerals and also coal. He stated that <br />the areas designated are not of commercial <br />value. <br /> <br />5. <br />
