<br />COUNCIL MEETING <br /> <br />December 5, 1972 <br /> <br />Regular meeting called to order ~r Mayor Lawrence Carand. <br /> <br />'OOLL CALL: <br /> <br />Present <br />Absent <br /> <br />King, Jensen" Ibnovan, Maxwell <br />&broski and Domenico <br /> <br />ACCEPTANCE OF MINUTES: AcceptE:ld,as presented. <br /> <br />LOWELL BUILDING CORP: <br />A subsidiary of First Nat:i.onal Bank of Denver - sul:tni tted a request for 125 <br />water taps. Annexation r1aquest on land just north of the City, over a period <br />of 5 years - consisting of 17 acres; Commercial 90; Single family 50 lots <br />of 3/4 acres each; i~ acre multiple family (4 p.'lex~~ which m~ be sold to the <br />occupant 0 Motion by D:mo'Van, seconded by Maxwell to refer matter to Planning <br />Commission for approval. Roll call vot,e - King No, Jensen No, Donovan Yes, <br />Maxwell Yes. Tie vote was broken by Mayor voting Yes. Fee per acre $50.00 <br />Check in the amount of $6,250 received and placed in Developers Fund. Fee to <br />be us ed to hire planne rs and. engineers. <br /> <br />SEWER ACQUISITION: <br />Attorney Morries stated that. the merger of the Sanitation District with the City <br />was about completed. District Court had dissolved the District, November 22, 1972. <br />Sani tation District to turn all assets and real property to the City. Bonds to <br />be pai.d off December 6, 19n~. Sanitation mstrict to pay all debts. <br />Mr. Wurl read bids on the SElwer plant and interceptor line. Ken Bruns recommended <br />low bidders - Penner Construction of Denver with bid of $248,556 on treatment <br />plant and Dye Construction of Colorado Springs $98,365 on interceptor line. <br />Deadline for letting bids, December 8, 1972 - ten days to sign contract <br />Attorney Morris stated e'Ver~rthing has to be approved by EPAo <br />Cmtact Ken Bruns on penalt~r clause, 180 days for completion - liquidation <br />damages of $100 per dayo Motion by ~novan, seconded by Maxwell that Ken Bruns <br />be instructed to enter into contract with both above firms prior to December 8, 1972. <br />Roll call vote Maxwell YE!S, Donovan Yes, Jensen Yes, King Yes. Motion carried <br />letter be sent to EPA for anproval. <br /> <br />SWIMHING POOL OOND ISSUE: <br />Mr. Krahl and Keith Helart presented ways to go on Bond issue which was awarded <br />to Boettcher and Compay. The longer the bond issue the higher interest. An <br />interest rate of 5% to bl:! p,aid out with ten years will be anproximately $32,750. <br />Paynlent due May 1, 1974. <br />Plan #2 - 5.30% interest fo:r 15 years. All publication- approximately $1,500 paid, <br />no charge for service; b:md attorney $875 to $975. <br />Keith recomnends Plan #2 - payment due May 1, 1972. Motion by Ibnovan, seconded <br />by Jensen to accept Plan #2. Roll call vote - Maxwell No, Donovn Yes, Jensen Yes, <br />King No. On tie vote Ma;ror voted yes. Donovan and Jensen reciended motion. <br />Motion by Donovan, secoruied by Jensen to accept Plan #1 - 5% non-callable payment <br />cut May 1, 1974, interest due semi-annually, pay $1.,500 for all services - delivery <br />date February 17, 1972. Bonding Co. be reimbursed for actual expense. Roll call <br />
