<br />ORDINANCE NO. 39, SERlES 2007 <br /> <br />INTRODUCED BY; Councilor Ruggeri <br /> <br />AN ORDINANCE AMD'DING SECTIONS 26.]7.5 AND 26.]7.6 OF CHAPTER <br />26, DEVELOPMENT AND ZONING, A;\,D AMENDING CHAPTER 30, <br />BU]LDING A;\,D BUILDING REGULATIONS, OF THE CODE OF <br />ORDINANCES OF LAFA YETTE, COLORADO <br /> <br />WHEREAS, the Planning Commission held a public hearing on May 23, 2007 to <br />hear from staff and the public regarding a proposal by City Council to develop a <br />residential visitability program; and <br /> <br />WHEREAS, the Planning Commission held a public hearing on July 24, 2007 to <br />review a draft residential visitability program prepared by staff; and <br /> <br />WIIEREAS, after studying the proposed amendments to Chapter 26 and Chapter <br />30 of the Code of Ordinances, and after hearing from both staff and the public, the <br />Planning Commission recommended approval of the following amendments; and <br /> <br />WHEREAS, a public hearing concerning this ordinance was held before the City <br />Council on August 2], 2007. <br /> <br />NOW, THEREFORE, THE CITY OF LAFAYETTE, COLORADO <br />ORDAINS: <br /> <br />SECTION I. That Subsection 26.17-5(b) of Chapter 26, Dcvclopment and <br />Zoning, of the Code of Ordinances of the City of Lafayene, Colorado is hereby amended <br />to include the following: <br /> <br />(8) In the case of a preliminary plan application that is subject to the <br />requirements of Article XV - Visitability, of Chapter 30 of the Lafayene Code of <br />Ordinances, a map indicating which units will be constructed in compliance with <br />the visitability regulations. Required visitable dwelling units shall be <br />geographically dispersed throughout the development, to the extent possible based <br />upon the topography or other justified reasons. If the proposed development <br />includes diversity of dwelling unit types then the visitable dwelling units shall be <br />dispersed within the various types of dwelling units proposed, to the extent <br />possible based upon the topography or other justified reasons. <br /> <br />SECTION 2. That Subsection 26-] 7-6(b) of Chapter 26, Development and <br />Zoning, of the Code of Ordinances of the City of Lafayene, Colorado is hereby amended <br />to include the following: <br /> <br />(9) In the case of a final plan application that is subject to the requirements of <br />Article XV - Visitability, of Chapter 30 of the Lafayene Code of <br />Ordinances, a map indicating which units will be constructed in <br />compliance with the visitability regulations. After approval of the final <br />plan by city council minor adjustments to the visitability portion of the <br />plan, such as relocating a visitable dwelling unit from one lot to another or <br />
