<br />City of Lafayette <br />Ordinance 39, Series 2007 <br />Page 3 of6 <br /> <br />accessible housing as well as the visitability requirements set forth herein shall count <br />toward the visitable home requirement. <br /> <br />Section 30-4] J. Definitions. <br />Dwelling means a building or portion thereof used for residential occupancy, and <br />conforming to any building code, fire code and safety code adopted by the City of <br />Lafayene. <br /> <br />Dwelling Unit means a structure or portion of a structure designed for occupancy <br />as a residence by a single family. <br /> <br />,'fixed-Use Derelopment means a development consisting of one (I) or more <br />principal buildings containing, either individually or collectively, both residential <br />and nonresidential principal uses. <br /> <br />Residential Del'elopment means the subdividing ofland into two (2) or more <br />parcels (lots, outlots, or tracts) designed for residential use, including Mixed-Use <br />Development with residential components and single lot or tract developments <br />that are used for residential purposes. <br /> <br />Visitable Dwelling Unit means a dwelling unit that complies with the <br />rcquirements of AJ1icle XV of Chapter 30 of the Lafayene Code of Ordinances. <br /> <br />"isftable Floor Level means the floor level of the visitable dwelling unit that is <br />accessed by the visitable route. <br /> <br />Visitable Route mcans the pathway that leads to an entrance of a visitable <br />dwelling unit. Such pathway does not include any steps or stair risers and does <br />not include provisions for a chair lift. <br /> <br />Section 30-4 1 2. Required Percentage of Dwelling Units. <br />(a) No fewer than twenty-five percent (25%) of all dwelling units located within <br />any Residential Development shall be designated, designed and constructed to comply <br />with the visitability requirements of Section 30-413. <br /> <br />Multi-family developments, and mixed-use developments that include a vertical <br />mix of uses, that have less than twenty-five percent (25%) of the total number of dwelling <br />units located on the ground floor level shall have those dwelling units that are not located <br />at the ground floor level exempt from these regulations, provided however that all ground <br />floor units shall be visitable dwelling units as defined herein. Accessory dwelling units <br />not located on the ground floor level are also exempt from these regulations. <br /> <br />(b) If the calculation of the number of visitable dwelling units that are required <br />pursuant to subsection (a) above results in a whole number and a fraction that is equal to <br />or greater than 0.75 then the total number of visitable dwelling units required within the <br />Residential Development shall be equal to the whole number plus one (1).
