<br />4.4 In addition, for the Fireworks on the Links, July 4, 2003, Contractor shall: <br /> <br />a. Coordinate the planning of the event with appropriate management staff at <br />the Coal Creek Golf Course. <br /> <br />b. Obtain sponsors for food booths; assign booth spaces; obtain commitments <br />from booth holders on charges which will be made to the public; determine <br />location of booths. <br /> <br />c. Obtain required approvals from the Colorado Department of Health and other <br />necessary licenses. and permits from the City of Louisville and other <br />applicable regulatory bodies. <br /> <br />d. Obtain required sponsors for relevant games and activities. <br /> <br />e. Arrange for entertainment during event including band concert and other <br />similar functions. <br /> <br />f. Coordinate provision of fireworks with Louisville Fire Protection District, other <br />organizations; coordinate provision of parking and other services with <br />appropriate City of Louisville departments. <br /> <br />g. Arrange for transportation to Coal Creek Golf Course from designated <br />parking areas in the City. <br /> <br />5.0 Independent Contractor. <br /> <br />5.1 The parties hereto agree and acknowledge that the Contractor is an <br />independent contractor for the City and is not an employee of the City. As an <br />independent contractor. the Contractor is not entitled to unemployment insurance <br />benefits unless unemployment compensation is provided by the Contractor and the <br />Contractor is obliQated to pay alii federal and state income tax on any and all moneys <br />paid pursuant to this AQreemertt. <br /> <br />5.2 The Contractor agrees to obtain and maintain comprehensive general liability <br />insurance approved by the City, and comprehensive automobile liability insurance in the <br />amount of at least $150,000 per pierson and $600,000 per occurrence so as to protect the <br />Contractor from all claims for injury or damages which may arise from the performance by <br />the Contractor of the Contractor's services required under the Agreement. The City, its <br />officers and employees shall be named as additional insureds on such insurance. The <br />Contractor shall provide the City with a certificate of insurance evidencing such coverages <br />at least five business days prior to July 4, 2003. All such policies shall contain a severability <br />of interests provision. <br /> <br />5 <br />
