02/21/2003 08:46A <br /> Boulder County Clerk, CO ORD R 16.00 D 0.00 <br /> <br /> WHEREAS, the City Council has determined that the alley right-of-way for which <br />vacation is requested is not being used or held for park purposes or for any other governmental <br />purposes; and <br /> <br /> WHEREAS, the City Council desires to approve the boundary line adjustment agreement <br />described herein, and the associated quit claim deed; and <br /> <br /> WHEREAS, the City Council desires to approve the application and vacate the City's <br />interests in the alley right-of-way described herein for which vacation is requested. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1, The City hereby approves the requested Boundary Line Agreement with the <br />owner of Lots 10 and 11, Block 11, Jefferson Place Subdivision in substantially the same form as <br />the copy of such Agreement accompanying this Ordinance. <br /> <br /> ~. The Mayor is authorized to execute such Agreement on behalf of the City, <br />except that the Mayor is hereby further granted the authority to approve such revisions to said <br />Agreement as the Mayor determines are necessary or desirable for the protection of the City, so <br />long as the essential terms and conditions of the Agreement are not altered. The Mayor is hereby <br />further authorized to execute the quit claim deed accompanying this Ordinance, and such additional <br />docurnents as may be necessary to effect the exchange of property interests between the Owner and <br />the City as described and depicted on the Agreement. Such execution shall be upon the condition <br />that the Owner first execute and deliver to the City the original Agreement and a quit claim deed for <br />areas outside of the "Resulting Parcel Description" for Lots 10 and 11, Block 11, as described in <br />such Agreement. <br /> <br /> Section 3. The City hereby vacates any portion of previously platted alley right-of-way <br />lying within the "Resulting Parcel Description" for Lots 10 and 11, Block 11, Jefferson Place <br />Subdivision, as described in such Agreement. Title to the vacated alley right-of-way shall vest in <br />the manner provided by law. <br /> <br /> Section 4. Easements are hereby reserved for the operation, maintenance, repair and <br />replacement of existing public utilities, if any, lying within the vacated alley right-of-way, and, <br />further, any existing easements for such utilities shall not be altered or amended by virtue of this <br />Ordinance. <br /> <br /> Section 5. The Mayor is authorized to execute such additional documents as may be <br />necessary to evidence the vacation of the alley right-of-way. <br /> <br /> INTRODUCED, READ, PASSED ON FIRST READING, AND ORDERED <br />PUBLISHED this 17th day of December, 2002. <br /> <br /> <br />
