Keany stated that he did not feel this was an appropriate use for this piece of land and did not want
to see this type of development on the entryway of Louisville.

Sisk agreed with Keany. He questioned why Council would grant a relief from the minimum parking
setback in an entryway area.

Davidson stated that on the preliminary PUD this site was indicated as a restaurant and not as retail
use. He agreed with Keany and Sisko He expressed concern that the internal road system could not
accommodate the traffic generated by a retail site. He explained that this area is intended to be the
gateway into Louisville, therefore, COlmcil is very restrictive with it.

. .

Haisfield replied that he asked for the parking setback variance only to be in line with the adjacent
property owners and he would have no objections to removing that request. He anticipates locating
tenants who can provide retail services such as a copy center, package shipping service or a mailbox
based service. These services would b~: useful to individuals staying at the adjacent hotels. He did
not believe these services would generate more traffic than a restaurant. ;

Sisk moved that Council forward the Final PUD Development Plan for Multi-tenant Retail/Office
Commercial Center - Lot 6B, Centennial Valley Parcel H to the Planning Commission with Council
comments, seconded by Keany. All in favor.

EXECUTIVE SESSION
Request for Executive Session by City Attorney re: Legal Consultation on Pending
Litigation - Colony Square LLC vs City of Louisville

Davidson called for the City Clerk statement.

Dave Clabots, City Clerk, read the Executive Session Statement.

Davidson explained the purpose of the Executive Session is to confer with the City Attorney and
special counsel regarding pending litigation - Colony Square LLC vs City of Louisville.

Davidson moved that Council adjoum into Executive Session.

Davidson called the meeting back to order and stated that during the Executive Session, there were
discussions with counsel regarding the pending lawsuit.

OTHER REGULAR BUSINESS ITEMS ARISING AFTER PREPARATION OF
AGENDA

NONE

25
