<br />(30) days after the date of Contractor 's invoice therefor. the amounts due Contractor under the <br />invoices shall bear interest at the ratle of 12% per annum or the maximum permissible by applicable <br />law. whichever is less. from the thirtieth day following the date of the invoice until paid unless the <br />delay in payment resulted from unsatisfactory work or documentation therefor. Payment shall be <br />made for work performed in proportion to the percentage of the task completed. <br /> <br />5.0 PROJECT REPRESENTATION <br /> <br />5.1 The City designates Peggy Flaherty as the responsible City staff member to provide direction to <br />the Contractor during the conduct of the project. The Contractor shall comply with the directions <br />given by Ms. Flaherty. <br /> <br />5.2 The Contractor designates Marc McLean as the Project Manager. The City may rely upon the <br />guidance, opinions, and recomme:ndations provided by the Contractor and its representatives. <br />Should any of the representatives listed in Exhibit B be replaced, particularly Mr. McLean, and such <br />replacement require the City or the Contractor to undertake additional reevaluations, coordination. <br />orientations, etc., the Contractor shall be fully responsible for all such additional costs and services. <br /> <br />6.0 TERM <br /> <br />The Contractor's services under this Agreement shall commence on January 30, 1998 and shall continue <br />until and be completed no later than July 31,1998. <br /> <br />7.0 INSURANCE <br /> <br />I .1 The Contractor shall procure and maintain, and shall cause each subcontractor of the Contractor to <br />procure and maintain, the minimum insurance coverages listed below. In the case of any claims- <br />made policy, the necessary retroactive dates and extended reporting periods shall be procured by the <br />Contractor to maintain such continuous coverage. <br /> <br />7.1.1 Workers' Compensation insurance as required by the Labor Code of the State of Colorado <br />~d Employers Liability Insurance. Evidence of qualified self-insured status may be <br />substituted. <br /> <br />7.1.2 General Liability insurance with minimum combined single limits of ONE MILLION <br />DOLLARS ($1,000,000) eac:h occurrence and ONE MILLION DOLLARS ($1,000,000) <br />aggregate. The policy shaJl include the City of Louisville, its officers and its employees, as <br />additional insureds, with primary coverage as respects the City of Louisville, its officers and <br />its employees. <br /> <br />7.1.3 Comprehensive Automobile Liability insurance with minimum combined single limits for <br />bodily injury and prope:rty damage of not less than ONE HUNDRED AND FIFTY <br />THOUSAND DOLLARS ($150,000) per person in anyone occurrence and SIX HUNDRED <br />THOUSAND DOLLARS ($600,000) for two or more persons in anyone occurrence, and <br /> <br />2 <br />
