ISAACSON, ROSENBAUM, WOODS LEVY, P.C.
Mayor Thomas Davidson
April 1, 1997
Page 2
However, if the issues in the March 31, 1997 memorandum cannot be addressed in a
satisfactory manner, then it certainly makes no sense for our client to voluntarily subject
their property to the Design Guidelines. To the extent that there are several areas within the
Gateway Design Guidelines where the City may have reserved some ability to supplement the
Gateway Design Guidelines, there certainly is the potential for disagreement about what the
City can and cannot do under those reservations.
This letter is delivered in the hope that the issues set forth in the March 31, 1997
memorandum are dealt with in a satisfactory manner so that we can go forward with the City
and other property owners on a common basis. However, if that does not occur, we are
prepared to assert our legal right to proceed under the Gateway Design Guidelines. A
failure to come to a resolution at this point will likely mean that the issues raised in the
March 31, 1997 memorandum will be of continuing concern to our client as they develop in
Centennial Valley.
LRK/dlg /i34o97
cc: Mr. Walter A. Koelbel, J
Mr. Jeffrey G. Sheets
Lawrence R. Kueter
