City Council <br />Study Session Summary <br />November 10, 2009 <br />Page 2 of 3 <br />In contrast, the current practice is that the Library Board of Trustees serves in an <br />advisory capacity. The current LMC is also inconsistent with the City Charter, <br />which provides for a home rule mayor council- manager form of government with <br />the City Council serving as the governing body, and the City Manager serving as <br />the chief administrative official of the City. <br />To address this issue City Manager Fleming met with the Board of Trustees and <br />reviewed proposed changes to the LMC. Since then, the Board has met a <br />number of times and drafted a proposal for changes to the LMC and the Board's <br />bylaws. City Manager Fleming still has a few concerns with the changes <br />proposed by the Board including the title "Board of Trustees the terms of <br />members, the phrase "as provided by Library Policy" and provisions concerning <br />budget review. The term "Trustee" is used for library districts with independent <br />taxing authority, not municipal libraries. The ambiguity in the Code has created <br />some subtle conflicts in the past. To avoid similar issues in the future, City <br />Manager Fleming proposed a few revisions to the language proposed by the <br />Library Board. He stated he intends to meet with the Board next week so he can <br />hear their perspective directly and share his on these issues <br />Council and staff emphasized the hard work and role the Board played in passing <br />the Bond measure to fund the new library and in the recent recruitment and <br />selection process for the new Library Director. <br />Regarding the term "Trustee" Mayor Pro Tem Marsella indicated she saw no <br />problem with continuing to use that term. Council member Sackett stated that it <br />could create problems because it does not accurately reflect the advisory role of <br />Library Board members. Council and staff also discussed Library Board member <br />terms. Council felt that five year terms were acceptable, although terms could be <br />staggered to maintain institutional memory and smooth transitions. <br />Mayor Sisk noted that the Library Board will have to meet the current open <br />meeting requirements. If they have a meeting after the library closes at 8:00 p.m. <br />it would violate this policy. The BOT needs to have the library doors open to <br />ensure entry to the public. <br />Councilors commented that the Town of Superior appointment of Lisa Skumatz <br />to the Library BOT be pursuant to the IGA, and not a permanent change to the <br />Bylaws. The language to incorporate this caveat should be provided to Sam <br />Light for review. City Manager Fleming noted that staff is also working on a set <br />of provisions that are applicable to all Boards and Commissions and he hopes to <br />share that with the Library Board too. <br />Public Comments None <br />City Manager Items and Future Agenda Items <br />
