ORDINANCE NO. 1386 SERIES 2002 AN EMERGENCY ORDINANCE REPEALING AND REENACTING CERTAIN PROVISIONS OF THE LOUISVILLE MUNICIPAL CODE TO PERMIT RATES AND CHARGES FOR WATER USAGE TO BE ESTABLISHED BY CITY COUNCIL RESOLUTION WHEREAS, the City Council finds that the waterworks costs paid through city water rates and charges have increased in recent years and are expected to increase in the future; and WHEREAS, certain city water,rates and charges are currently established by ordinance; and WHEREAS, the City Council fmds that the setting and adjustment of the City water rates and charges by ordinance is a cumbersome procedure that does not allow timely adjustments to the water rates and charges; and WHEREAS, the City Charter authorizes and permits the Council by ordinance or resolution to fix, establish, maintain and provide for the collection of rates, fees, and charges for water and other utility services furnished by the City; and WHEREAS, the City Council desires to repeal and reenact certain provisions of the Louisville Municipal Code to permit rates and charges for water usage to be established by City Council resolution, which the City Council has determined is the most efficient means to set and maintain accurate and up-to-date water rates and charges. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. Section 13.12.080 of the Louisville Municipal Code are hereby repealed and reenacted to read as follows: Sec. 13.12.080. Bulkwater charges. Water service not supplied to a specific property location by a standard tap shall be sold at rates and charges as established by resolution of the city council. Section 2. Section 13.12.090 of the Louisville Municipal Code is hereby repealed and reenacted to read as follows:
