Sec. 13.12.090. Metered service. <br /> All new taps installed within or without the City shall be installed with a <br />meter provided by the City. All water sold by the City shall be sold at rates and <br />charges as established by resolution of the city council, and meter rates for users <br />outside the city limits shall be double the rate for users inside the city limits. Such <br />rates and charges may include without limitation surcharges for excessive use of <br />water. <br /> <br /> Section 3. The City Council herewith finds, determines and declares that this ordinance <br />is necessary for the immediate preservation of the public health and safety in order to effectuate the <br />timely establishment of water usage rates and charges, and that this ordinance shall take effect June <br />5, 2002, provided the same has been adopted and signed by the Mayor and approved by two-thirds <br />of the entire City Council. <br /> <br /> Section 4. This Ordinance is repealed effective 12:00 a.m. on June 5, 2004 and shall <br />remain in effect only until such time and date. The foregoing shall not be deemed to limit the <br />authority of the City Council to amend or repeal this Ordinance prior to such time and date. <br /> <br /> Section 5. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact <br />that any one part be declared invalid. <br /> <br /> Section 6. The repeal or modification of any provision of the Municipal Code of the <br />City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole <br />or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred <br />under such provision, and each provision shall be treated and held as still remaining in force for the <br />purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the <br />enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any <br />judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, <br />proceedings, or prosecutions. <br /> <br /> Section 7. All other ordinances or portions thereof inconsistent or conflicting with this <br />ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict. <br /> <br /> INTRODUCED, READ, PASSED AS AN EMERGENCY ORDINANCE AND <br />ORDERED PUBLISHED this 21st day of May, 2002. <br /> <br />Tom Davidson, Mayor <br /> <br />2 <br /> <br /> <br />
