35. <br /> <br />36. <br /> <br />37. <br /> <br />37. <br /> <br />38. <br /> <br />Mass limit or mass loading means the total number of pounds of a pollutanl <br />allowed to be discharged during a specific time period. <br /> <br />Monthly average means the arithmetic mean of the concentration values of a <br />pollutant in the effluent during a calendar month or as otherwise defined by th~ <br /> <br />approving authority. <br /> <br />National pollutant discharge elimination system (NPDES) means the program for <br />issuing, conditioning and denying permits for the discharge of pollutants from <br />point sources into navigable waters of the contiguous zone and the oceans <br />pursuant to Section 402 of the Clean Water Act (P.L. 95-217, 33 USC, Section <br />1342). <br /> <br />National pollution discharge elimination system permit or NPDES permit means a <br />permit issued pursuant to Section 402 of the Act (P.L. 95-217, 33 U.S.C., Section <br />1342), including permits issued by the state of Colorado in compliance with thc <br />Act. <br /> <br />39. <br /> <br />40. <br /> <br />National prohibitive discharge standard or prohibitive discharge standard means <br />any regulation developed under the authority of 307(b) of the Act and 40 CFR, <br />Section 403.5. <br /> <br />New source means: <br />1.any building, structure, facility or installation from which there is or may be a <br />discharge of pollutants, the construction of which commenced after the <br />publication of proposed pretreatment standards under Section 307(c) of the Clean <br />Water Act which will be applicable to such Source if such standards are thereafter <br />promulgated in accordance with that section, provided that: <br /> <br />a. The building, structure, facility or installation is constructed at a site at which <br />no wastewater source is located; or <br /> <br />b. The building, structure, facility or installation totally replaces the process or <br />production equipment that causes the discharge of pollutants at an existing source; <br />or <br /> <br />c. The production of wastewater generating processes of the building, structure, <br />facility or installation are substantially independent of an existing wastewater <br />source of the same site.
