ORDINANCE NO. _____ <br />SERIES 2009 <br />AN ORDINANCE AMENDING SECTIONS 2.64.010, 2.64.020 AND 2.64.030 OF THE <br />LOUISVILLE MUNICIPAL CODE REGARDING MANAGEMENT AND CONTROL <br />OF THE LIBRARY AND APPOINTMENTS TO THE LOUISVILLE LIBRARY BOARD <br />WHEREAS, <br /> the City Charter provides for a home rule mayor-council-manager form of <br />government with the City Council serving as the governing body of the City responsible for <br />exercising all powers and responsibilities not conferred by the Charter on others, and with the City <br />Manager serving as the chief administrative official of the City; and <br />WHEREAS, <br /> under the City Charter the City Manager, subject to the Council’s oversight, is <br />responsible for among other things, administration of the budget adopted by the City Council and <br />exercising supervision and control over all City personnel and departments, and for the enforcement <br />of ordinances, resolutions, franchises, contracts, and other enactments of the City; and <br />WHEREAS <br />, Sections 2.64.010 and 2.64.030 of the Louisville Municipal Code currently <br />provide that the management and control of the Louisville Public Library is vested in the Board of <br />Trustees, and that the Board of Trustees shall have all of the powers and duties that are granted by <br />C.R.S. Section 24-90-109; and <br />WHEREAS <br />, in current practice the Library Board of Trustees serves in an advisory <br />capacity to the City Council and does not exercise management and control of the library; and <br />WHEREAS, <br /> Sections 2.64.010 and 2.64.030 of the Louisville Municipal Code, in vesting <br />management and control of the Library in the Library Board of Trustees and granting to the Board <br />of Trustees all the powers and duties that are granted by C.R.S. Section 24-90-109, are inconsistent <br />with both the City Charter and current practice; and <br />WHEREAS, <br />the City Council, acting pursuant to the City’s home rule authority, desires to <br />amend these Sections of the Code to revise the name, powers and duties of the Library Board of <br />Trustees so as to ensure that the City Council and City Manager are able to effectively fulfill their <br />responsibilities under the City Charter and provide for the effective administration of the Library; <br />and <br />WHEREAS, <br />Section 2.64.020 of the Louisville Municipal Code currently provides that <br />appointees to the Louisville Library Board of Trustees shall be residents of the City; and <br /> WHEREAS <br />, the City of Louisville has entered into an Intergovernmental Agreement with <br />the Town of Superior to address contributions by Superior for the operating costs for library <br />facilities and services provided by Louisville, as well as options for resolving issues concerning <br />long-term access to library services for residents of Superior; and <br />1 <br /> <br />
