<br />City Council <br />Meeting Minutes <br />October 20,2009 <br />Page 14 of 15 <br /> <br />COUNCIL COMMENTS <br /> <br />Councilor Dalton clarified the moratorium is not on the two businesses operating <br />in the City. The moratorium is for any new businesses who wish to operate <br />medical marijuana dispensaries in the City of Louisville. <br /> <br />Mayor Sisk explained the City is trying to find a logical basis for which medical <br />marijuana dispensaries can be regulated. The City recognizes property rights of <br />the two individuals who have opened medical marijuana dispensaries. The <br />moratorium is only until May 15, 2010 and will allow the City to look at the various <br />scenarios. He asked the public to work with the City of Louisville. <br /> <br />Councilor Muckle stressed the City is not closing the two operating businesses, <br />but waiting for guidance for the state legislators or the health department relative <br />to regulating medical marijuana dispensaries. <br /> <br />PUBLIC COMMENTS <br /> <br />Jeremy De Pinto, 1162 CE~dar Street, Broomfield, CO presented seven copies of <br />a report entitled "Encoura~lin~1 the Economic Development of Medical Cannabis <br />Businesses in Colorado", which was written by the Cannabis Therapy Institute. <br /> <br />Mayor Sisk closed the public hearing. <br /> <br />MOTION: Mayor Pro Tem Marsella moved to approve Ordinance No. 1561, <br />Series 2009 with the follovvin~l amendments: The addition of the words grow and <br />produce to Section 6 and with direction to City Staff to issue letters to existing <br />businesses that are in conformance with their invested rights, seconded by <br />Councilor Clabots. <br /> <br />City Attorney Light offered a friendly amendment that all the second reading <br />amendments to the ordinance be included in the motion, and in Section 6 the <br />definition be revised to add "use of any property or structure to sell, distribute, <br />produce, grow, transmit, glive or dispense marijuana" and to Section 9 the <br />following phase be added: "pursuant to the foregoing it is determined herein, the <br />restriction shall not apply to Compassionate Pain Management located at 1116 <br />Dillon Road, Suite 7, or Altermed, LLC at 1115 W. Dillon Road #3, as such <br />developments and uses existed as of October 20, 2009. <br /> <br />City Manager Fleming asked City Attorney Light how Section 9 and Section 2 <br />would affect Staff's ability to deal with the two existing businesses in Louisville. <br />City Attorney Light explained the language revision in Section 9 provides the <br />restriction in Section 2, prohibiting certificate of occupancies, shall not apply to <br />the two existing businesses. <br />
