used along the ridge line. She felt strips of green turf would be disturbing to the ridge line. She
wanted the noxious weeds killed back.

Davidson called for anyone else wishing to speak on Ordinance No. 1277 and Resolution No. 4.

NONE

Davidson closed the public hearing and called for Council comments or questions.

Mayer suggested dispensing with the 30' and there be an outlot for the trail connection and room for
a utility and access easement.

Lathrop wanted to the trail access issue left open and not be site specific until a later date. He did
not like the trend developing of Planning Commission members coming to Council with minor issues.

Sisk wanted the rezoning issue resolved. He did not want a gas station or drive-ins on any of the lots.

Keany felt there should be a restriction on west facing signs on Lots 11 - 14.

David Johnson, Etkin Equities, thought the signs facing west applied to Lot 11 - 14. Lots 15 - 18
face Hwy. 42.

Davidson stated that this is an industrial park and gas stations should be allowed. He felt open space
along 104th would be the most appropriate place other than the ridge itself. He pointed out that the
open space definition is different today from what it was years ago. In the '70's it may have been a
public use dedication, not an open space dedication. He suggested doing it as fee simple, signing a
contract with the property owner for them to maintain it.

Howard did not want to give away the fee simple, but would allow the owners to maintain the
property. He did not want the signage to be garish like a lot of neon. He wanted No. 4 to read that
the more restrictive of the two apply.

Davidson asked for the applicant's summary.

Lee stated that with the buildings along the ridge the setback of 20', with parking as per the
stipulation, is a must. If the 110' along Hwy. 42 should become a dedication, then there would be
a bigger setback from there and those lots do not work. He asked for a five minute recess for
discussion on the dedication.

DAVIDSON CALLED FOR A TEN MINUTE RECESS

Davidson called the meeting back to order.
