3.) <br /> <br />5.) <br /> <br />7.) <br /> <br />The subdividers shall fulfill his respective open space dedication obligation as required <br />by annexation agreements both by the Mizel/Ward annexation as well as by the <br />Subdivision Agreement for the Colorado Tech Center Filing No. 1. <br />The Final PUD shall be modified to reflect a 20' rear building setback running adjacent <br />to and parallel with the southerly line of Outlot D. Parking within the rear setback <br />will be permitted, but must be fully screened from Hwy. 42. Screening and buffering <br />measures shall insure that glare is not projected off of the premises of the parking lot <br />and that this provision supersedes any other provisions. <br />The final grading and drainage plan shall be approved by the Department of Public <br />Works prior to recording the Final Subdivision Plan. <br />The phasing plan shall be revised to reflect that South 104th Street shall be <br />constructed by the CTC Metro District in Phase I. In the event the District does not <br />construct road improvements, the subdivider shall be obligated to construct the <br />portion of South 104th Street, north of Taylor Avenue. Taylor is extended to South <br />104th Street in Phase II. The balance of 104th Street shall be constructed in Phase <br />II. Prior to the development of lots fronting South 104th Street, the subdivider shall <br />be required to execute a development agreement and secure same with the required <br />guarantee in a form acceptable to the City prior to the issuance of building permits in <br />the respective phases. <br />The subdivider or his guarantees shall be required to convey fee title to the City for <br />an outlot to function as a pedestrian trail connection, the width of which to be agreed <br />upon by the applicant and the City staff and signed by the Mayor. Utility and access <br />easement at/or prior to PUD review for Lots 11 - 14. <br />The subdivider shall convey easement parcels No. 1 - 4 by Conservation Easement <br />Deed at or prior to the recording of the Final Subdivision Plat. <br />A conceptual plan for the 110' easement grading as well as landscaping be done for <br />the entire 110' easement, Lots 1, 3, 16, 17, 18, and 19, when the first building is <br />brought before Council. <br /> <br />Mayer seconded. <br /> <br />Davidson offered a friendly amendment that at the very end of condition No. 3, add "Less than .6 of <br />an acre, which shall be provided on other property along 104th Street." <br /> <br />Howard and seconder Mayer accepted that. <br /> <br />Mayer offered a friendly amendment that the grading and landscaping plan be accepted by the City <br />and the applicant, prior to or along with the Conservation Easement being executed, before/with <br />approval of the first PUD. <br /> <br />Sam Light, City Attorney, in a point of clarification, stated that it would be at or prior to recording <br />of the approvals. <br /> <br /> <br />
