the clear understanding that the applicant is taking full responsibility to eliminate as many outstanding <br />issues as possible. <br /> <br />Sisk called for the applicant's presentation. <br /> <br />Greg Gastineau, 1427 Mapleton Avenue, Boulder, Colorado, stated there were no objections to the <br />conditions for approval; however, they would like to dari~ the additional setback issue. A letter was <br />written to the Maple Grove Homeowners Association earlier this year to make them aware of the <br />project (the letter was addressed to the acting secretary, Camma Love). No reply to the letter was <br />recieved. City staff provided a copy of a letter they received from the Maple Grove Homeowners <br />Association stating their concerns about the project. A meeting with the Maple Grove Homeowners <br />Association had not occurred due to scheduling conflicts. One solution would be to bury and pipe <br />the irrigation ditch, alleviating the concems about trash collection and storm water runoff mixing into <br />their channel. An engineer is evaluating this option. <br /> <br />Keany requested that the landscape plan be adjusted to move the trees out of the ditch easement. <br /> <br />Sisk asked for the applicant's open space intentions. <br /> <br />Gastineau stated the initial proposal was for cash-in-lieu of open space; however, that was not <br />approved. They are working with the Parks Department to acquire a four-acre site for a community <br />park. <br /> <br />Sisk called for public comments. <br /> <br />Bill Avery, 11026 Maple Road, Lafayette, Colorado expressed the concerns of several residents. He <br />stated they were not made aware of the project until after the Planning Commission presentation. He <br />had left several telephone voice mail messages for Mr. O'Connor and Mr. Gastineau; however, they <br />have not returned any of these calls. Mr. Gastineau was contacted last Thursday with an offer to meet <br />with the homeowner's board and irrigation committee. The meeting was tentatively scheduled for <br />last night, with Mr. Gastineau agreeing to call and confirm the meeting on Friday. No call was <br />received. Mr. Gastineau was phoned yesterday to determine if the meeting could be held. He agreed, <br />at approximately 3 p.m., to meet at 6 p.m., leaving insufficient notice in which to contact the board <br />and irrigation committee members. Several solutions have been presented to O'Connor Development <br />and they have not accepted any of them. Mr. Avery requested a continuation of the matter in order <br />to address the homeowners concerns and to resolve the conflicts and inconsistencies between the <br />PUD and the plat. The homeowners would not object to burying the pipe and irrigation ditch; <br />however, they would ask that the pipe size be adequate to service their system and that it be <br />continued to the east side of 104th Street. The homeowners stated that lack of cooperation from <br />O'Connor Development is creating significant frustration. Mr. Avery asked that he be allowed to <br />represent the neighborhood at future meetings involving discussion on the matter. <br /> <br />Sisk agreed and called for Council questions and comments. <br /> <br /> <br />
