he would like to see in Louisville. He complimented the applicant on their project. He agreed with <br />Sisk in regard to limiting the on-site truck parking to no more than twenty-four hours. <br /> <br />Diesendorf briefly summarized the project. He expressed appreciation for the cooperation they have <br />received from the City of Louisville. <br /> <br />Wood stated the Planning Commission recommended that outdoor sales be limited to fourteen days. <br />The applicant does have the right to apply for a temporary use permit allowing seasonal sales up to <br />forty-five days, and up to sixty days with Council approval. <br /> <br />Davidson replied that he understood the agreement to be no outdoor sales would be allowed without <br />the applicant following the administrative process of applying for a temporary use permit for outdoor <br />or seasonal sales. <br /> <br />Howard felt that the same policy should be applied to every vendor and since other vendors are <br />holding outdoor sales, this applicant should be afforded the same opportunity. <br /> <br />Lathrop moved that Council approve Resolution No. 29, Series 1998 - Final Subdivision Replat <br />Centennial Valley Filing No. 7 and a PUD Development Plan on Lot 2 for Sam's Club with the <br />following conditions: conditions one through four as presented in Resolution No. 29 and adding <br />condition number five to read that truck/trailer units are to be parked/stored on-site in the loading <br />dock area with restriction as to on-street or off-street parking and condition number six to read that <br />seasonal sales or outside sales would be by temporary use permit administered through staff, <br />seconded by Keany. <br /> <br />Sisk offered a friendly amendment to condition number five that the truck storage would be confined <br />solely to the dock area, and would not be in the parking area or on the street, accepted by Lathrop <br />and Keany. <br /> <br />Roll call was taken. Motion passed by a 6-0 vote. <br /> <br />PROPOSED SALES TAX REBATE PROGRAM - SAM'S CLUB <br /> <br />Davidson called for staff introduction. <br /> <br />Sam Light, City Attorney, explained that on May 5, 1998, City Council forwarded comments to the <br />Planning commission regarding the proposed Sam's Club PUD on Centennial Valley Parcel 'O' <br />adjacent to Albertsons. At that time, the Council had also received from Koelbel & Company <br />a proposal for a sales tax rebate program concerning the proposed Sam's Club. Highlights of that <br />proposed sales tax rebate program are as follows: <br /> 1. One year term for a sales tax rebate beginning January 1, 1999 and terminating <br /> December 31, 1999. Should Sam's Club not be open for business by January 1, 1999 <br /> then the term would run 12 months from the opening of business. <br /> <br /> <br />
