<br />City Council <br />Meeting Minutes <br />February 16, 2010 <br />Page 10 of 15 <br /> <br />Mayor Sisk voiced his concern over the expiring contract and the fact the Golf <br />Course has operated in the red for the past three years. He asked City Attorney <br />Light if the proposal is in violation of the City's Charter with respect to leases. <br /> <br />City Attorney Light explained the Charter specifies a lease, with respect to parks <br />or open space cannot be entered into without a vote. In October WGP offered to <br />lease the golf course from thEl City. He explained a lease is to have exclusive <br />rights over the property. One condition of the lease would be the property would <br />always remain a golf course and the City would maintain control as owner. It was <br />determined there would be no greater interest in the land than a non-exclusive <br />license of the premises as the City's Golf Course manager. With respect to <br />capital improvement, the City may choose to or choose not to participate in the <br />purchase in capital investments. With respect to the Charter, the City cannot <br />divest their interest in the golf course and cannot give them exclusive use or <br />possession of the property. <br /> <br />Mayor Sisk agreed more information is needed and was not comfortable with <br />WGP refusing to do business with local vendors. He did not want to reward a <br />company who has not performed well in the last three years and suggested <br />continuing the discussions on the Western Golf Properties Agreement to the <br />March 2, 2010 City Council meeting. <br /> <br />Councilor Sackett agreed and noted he had spoken to a WGP representative, <br />who stated they are willing to extend the contract to whatever time it takes. They <br />want to provide a solid agreement, which meets the needs of both parties. <br /> <br />Councilor Dalton suggested working with WGP on a month-to-month extension of <br />the agreement. Mayor Pro Tl8m Marsella did not have a problem with continuing <br />the matter, but did not support a month-to-month extension of the agreement. <br /> <br />Councilor Dalton stated the Council must understand WGP vision for the golf <br />course and requested more information. <br /> <br />Mayor Sisk asked City Mana!~er Fleming to project a reasonable time for WGP to <br />make their presentation. City Manager Fleming reviewed Council's requests for <br />additional information as follows: 1) What is WGP's plan for turning around the <br />operation of the golf course; :2) What is WGP's vision for the golf course; 3) What <br />is WGP's 5-year Capital Plan; 4) How would WGP prioritize the capital <br />investments for which the City would approve; 5) The specific structure for the <br />advisory committee, in a draft resolution, which would address the number of <br />members and the appointment procedures. <br /> <br />Mayor Sisk requested City Manager Fleming ask WGP how they intend to turn <br />the situation around in a proactive manner and how are they going to address <br />
