COUNCIL COMMUNICATION <br />TO: MAYOR AND CITY COUNCIL <br />FROM: MALCOLM FLEMING, CITY MANAGER <br />DATE: JANUARY 12, 2010 <br />SUBJECT: LOUISVILLE HOUSING AUTHORITY AMENDMENT - HABITAT FOR <br />HUMANITY DISCUSSION <br />ORIGINATING DEPARTMENT: ECONOMIC DEVELOPMENT DEPARTMENT <br />SUMMARY: <br />In April, 2003 the City Council entered into an agreement with the Louisville Housing Authority <br />(LHA) in order to transfer ownership of a tract of land on South Boulder Road, approximately <br />.58 acres in size. The reason for the transfer was to allow the LHA to develop the land for <br />affordable housing. The agreement contains some specific conditions that the LHA now would <br />like to amend. They ask that certain provisions be amended in order to allow further transfer <br />from the LHA to Flatirons Habitat for Humanity (FHFH). FHFH has proposed to take ownership <br />of the site for no charge, and in return will commit to build 4 units of housing affordable to <br />households earning no more than 60% of the Area Median Income. Today, that category <br />would include households of four persons earning approximately $53,500 annually. <br />If the land is transferred to FHFH, there would likely be several issues that may of concern <br />including: <br /> The existing agreement envisions the LHA would develop and own the affordable units. <br />In contrast, FHFH is proposing to own the units only until the subsequent sale to a <br />resident. <br /> LHA normally pays development fees and charges. In contrast it is likely that FHFH <br />would request fee waivers. <br /> LHA maintains the units it owns. In contrast, Habitat would establish a small HOA to <br />monitor maintenance. <br /> Under the existing agreement, the property can not be transferred without giving the City <br />a 90-day first right of refusal. If the land is transferred to FHFH, FHFH’s ownership <br />should also be subject to this provision if FHFH does not build the units as proposed. <br /> Whether both the City and LHA will be beneficiaries of affordable housing covenants and <br />which party would be primarily responsible to monitor/enforce compliance with the <br />covenant(s). <br />In October 2009, John Lovell, Executive Director of FHFH, presented to the LHA his plans for <br />the development and management of housing on this property. At the December 8 LHA <br />meeting, LHA voted to recommend the Council view a presentation from Mr. Lovell and take <br />the necessary steps to allow FHFH to accomplish the plan.
