The proposed location of all streets. <br />In the case of this application, the GDP is combining two zoning elementsinto one <br />document:the initial zoning of PCZD-C for the 80 acre parcel (Item A under Case 09-12- <br />ZN),and the rezoning of the 310 acresfrom Industrial and Agriculture to PCZD-C (Item B <br />under Case 09-12-ZN).The PCZD-Commercial district use regulations in Chapter 17.72 <br />provide sufficient latitude to accommodate all the permitted uses requested on the GDP. <br />These uses include research/office and corporate uses;noncommercial support services, <br />and facilities for the manufacturing, fabrication, processingor assembly of scientific or <br />technical products, or other products, as further described under the Permitted Uses table <br />on the GDP. <br />The City Council approved a Resolution of Substantial Compliance on January19, 2010 <br />setting the public hearing date for the annexation and zoning for March 16, 2010. Once a <br />substantial compliance resolution has been passed, state law permits the zoning process <br />to commence. The current processing schedule contemplates that the Planning <br />Commission’s recommendation on the proposed zoning would be packaged for Council <br />review at the same time as the proposed annexation. This wouldresult in a joint <br />zoning/annexation hearing before Council on March 16, 2010. <br />Based upon the current review time line, the GDP is scheduled for final review and <br />approval concurrent with thereview of the preliminary plat and PUDPlan.As a result of <br />thisschedule, the GDP must provide justification for the proposeduse and phasing prior to <br />the review of the final plat and final PUD development Plan. Additionally, the applicant is <br />requesting a vestedrights agreement relative to land uses, density, height standards and <br />other yard and bulk requirementsat a time prior to final PUD development plan approval <br />(See attached letter). The LMC currentlyallows for such vestingonly at the final PUD <br />developmentplan submittal. Toenable the City Council to consider the approval ofa <br />vestedrights agreement at an earlier stage in the development process, should City <br />Council desire to do so, staff intends to submit for Council consideration a proposed <br />change to the LMC. Becausethe proposed code change would be for amendments to title <br />17 of the LMC, the amendments are also subject to review and a recommendation by <br />Planning Commission.Accordingly, staffwill submit the proposed code change to the <br />Planning Commission for consideration during the Commission’s February 25 meeting. <br />Water and Wastewater Utilities <br />At the time the staff report was prepared,ConocoPhillipshad not been able to accurately <br />determine theprojected demands on the City’s water and wastewater utilities.Therefore, <br />impacts to overall water resource needs and peak period plant capacities have not been <br />quantified. Public Works staff will continue to work with ConocoPhillips to make sure this is <br />resolvedby final submittal. <br />Louisville Fire Protection DistrictParcel <br />An additionalapplication was submitted jointly by ConocoPhillips and the Louisville Fire <br />Protection District (Fire District)to include a 1.5 acre parcel owned by the Fire Districtin the <br />proposed GDP for rezoning to PCZD-C.This parcel is located on thesoutheast corner of <br />9 <br /> <br />
