RESOLUTION NO. 61 <br />SERIES 2001 <br /> <br /> A RESOLUTION APPROVING <br /> A FINAL SUBDIVISION PLAT, <br />FINAL PUD DEVELOPMENT PLAN AND <br />SPECIAL REVIEW USE FOR <br />CENTENNIAL PAVILION <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a final subdivision plat, final PUD development plan and special review use for <br />Centennial Pavilion; and <br /> <br /> WHEREAS, all materials related to the subdivision plat, final PUD development plan <br />and special review use have been reviewed by City Staff and the Planning Commission and, <br />with conditions have been found to comply with the Louisville zoning ordinances, subdivision <br />regulations, the Commercial Development Design Standards and Guidelines, related policies <br />and previous approvals; and <br /> <br /> WHEREAS, after duly noticed public hearings concerning said application on <br />September 20, October 9 and November 13, 2001, where evidence and testimony were entered <br />into the public record, including the Staff Reports dated September 20, October 9 and <br />November 13, 2001, the Planning Commission recommended approval to the City Council, <br />with conditions; and <br /> <br /> WHEREAS, the applicant has submitted revised plans and a response letter, which <br />address the Planning Commission recommended conditions of approval; and <br /> <br /> WHEREAS, City Council has reviewed the application and finds that said final <br />subdivision plat, final PUD development plan and special review use should be approved, with <br />the following conditions. <br /> <br />Prior to recordation of the Plat and PUD, the applicant shall provide an executed 20-foot <br />public access easement and off-site grading easements (both for the construction of the <br />shared drive and for sight visibility) from the property owner immediately north of this <br />project. <br /> <br />2. It shall be noted on the PUD that the oil change facility shall be required to keep its <br /> overhead doors closed during the servicing of vehicles. <br /> <br />3. The spacing between the Northern Red Oaks and the Imperial Honeylocust adjacent to <br /> McCaslin Blvd. shall be increased to a minimum of 25 feet on center. <br /> <br /> <br />
