A July 21, 1998, letter received from the applicant indicates that truck deliveries would occur three <br />times a week. A note has been added to the PUD which restricts the parking of truck trailers in any <br />location other than the designated loading dock area. A noise study dated July 23, 1998, from David <br />L. Adams Associates, Inc., concludes that operation of the noise compactors will not exceed the <br />State's most stringent night-time noise limit of 50 decibels. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />Steve Wilson, CLC Associates, 8480 E. Orchard Road, Suite 2000, Englewood, Colorado, <br />distributed computer-simulated perspectives on the location and appearance of the building. He <br />briefly explained why they are requesting relief from the Planning Commission conditions regarding <br />colored concrete, finished floor elevation, and signage. He presented a compromise proposal on <br />signage. <br /> <br />Davidson called for Council comments and questions. <br /> <br />Levihn agreed with the applicant regarding the three outstanding conditions. <br /> <br />Mayer suggested adding extra evergreen trees to screen the loading bays from Dillon Road and <br />Dahlia Street. He thanked Kohl's for their responsiveness to Planning Commission and Council <br />comments and suggestions. <br /> <br />Lathrop agreed with the applicant regarding the three outstanding conditions. <br /> <br />Howard agreed with Lathrop and Levihn. <br /> <br />Mayer moved that Council approve Resolution No. 44, Series 1998, Kohl's Department Store - Final <br />Development Plan, Lot 3, Centennial Valley Parcel 'O' with the following amendments: <br /> <br />In lieu of compliance with CDDSG, the applicant shall receive authorization <br />of the requested open space credit. <br /> <br />The landscape plan shall be revised to add six additional evergreen trees in <br />Lot 11 where the parking lot is immediately adjacent. <br /> <br />The applicant shall grant the City perpetual easement(s) for public way <br />necessary to establish an unobstructed 60-foot public way/yard area adjacent <br />to the north building elevation, in a form acceptable to the City Attorney. <br /> <br />A revised photometric shall be submitted and approved by staff and shall <br />provide low level, bollard, pedestrian scale lighting the entire length of the <br />pedestrian walkway located in the west parking lot, and also around the <br />gazebo amenity. <br /> <br />19 <br /> <br /> <br />
