Howard asked whether the applicant is willing to accept a letter from the City, drafted by the City <br />Attorney and approved by staff and the applicant, concerning Lots 3 and 4. <br /> <br />Feinberg stated a letter similar to what Sam Light, City Attomey, just expressed would be acceptable. <br /> <br />Davidson offered a friendly amendment that conditions 3, 4, 5, and 6 be removed and a new <br />condition 3 and 4 be added to read: <br /> 3. All off-site signage not currently authorized by the overall PUD is removed from this <br /> application. Any requests for any such additional signage shall be processed through <br /> a separate proposed amendment to the overall PUD. <br /> 4. At or prior to recording of the Final Replat and PUD, the owner shall record a notice <br /> encumbering Lots 2 and 4 which states that such lots are subject to all applicable <br /> requirements of the overall PUD and Commercial Development Design Standards <br /> and Guidelines (CDDSG), which specifically states the remaining square footage <br /> which may be allocated among Lots 2 and 4 and states that no owner of such lots <br /> shall be entitled to any exception to the requirements of the overall PUD or to the <br /> CDDSG on the basis of any proposed allocation of remaining square footage. <br /> <br />Feinberg requested that condition number 4 read 'Lots 2 and 4 combined.' <br /> <br />Davidson agreed. <br /> <br />Amendment was accepted by Keany and Mayer. <br /> <br />Motion passed by a 6-0 vote. <br /> <br />ORDINANCE No. 1281, SERIES 1998 - AN ORDINANCE AMENDING TITLE 17 OF <br />THE LOUISVILLE MUNICIPAL CODE TO ADD A DEFINITION OF EXTENDED <br />STAY LODGING FACILITY AND TO ALLOW SUCH FACILITIES IN THE <br />COMMERCIAL-BUSINESS (CB) ZONE DISTRICT SUBJECT TO A SPECIAL <br />REVIEW USE - 2nd READING - PUBLIC HEARING (Published Louisville Times 7/25/98) <br /> <br />Davidson called for City Attorney introduction. <br /> <br />Sam Light, City Attorney, read by title only, Ordinance No. 1281, Series 1998 - An Ordinance <br />Amending Title 17 of the Louisville Municipal Code to Add a Definition of Extended Stay Lodging <br />Facility and to Allow Such Facilities in the Commercial Business Zone District Subject to a Special <br />Review Use. <br /> <br />Davidson called for staff introduction. <br /> <br />Paul Wood, Planning Director, stated that this is the 2nd reading of Ordinance No. 1281, Series <br />1998, which creates a new definition of extended-stay lodging facility..
