certain revisions have been incorporated. The definition as drafted does allow for the provision of
a kitchen with limited cooking facilities, strikes any reference to apartment hotel and tourist home,
and requires a 24-hour front desk service. Section 17.12.303, which is the listing of use groups, is
being amended to create an additional use group for an extended stay lodging facility. The use group
would authorize such uses in the Commercial-Business District (CB) only, in all other districts it
would be an excluded use. Finally, Section 17.16.155 (District Regulations) is being amended to add
a section regarding extended stay lodging facilities. Under this section, the operations of the
extended stay lodging facility are further defined in terms of duration of occupancy and the need to
maintain an annual business licence. This section further states that no extended stay facility, or any
unit therein, shall be converted to a multi-unit dwelling or multi-family dwelling, or any other form
of permanent residence. As an amendment to the first reading, an exception for corporate guests
pertaining to the use of the units for storage has been eliminated.

Davidson requested that the City Attomey read aloud an additional change to the proposed
Ordinance.

Sam Light, City Attorney, stated that on page 2, under the numbers 17.16.155, subsection A, an
additional sentence would be added to read: 'Any extended stay lodging facility shall be based on
a daily rental rate.'

Davidson opened the public hearing and called for anyone in the audience wishing to speak on
Ordinance No. 1281.

NONE

Davidson closed the public hearing.

Davidson called for Council comments and questions.

Mayer commented that most of the zoning classifications are approximately 40-50 years old and
requested that the Planning Department along with the Planning Commission review and update the
classifications.

Howard moved that Council approve the amendments to Ordinance No. 1281, Series 1998,
Amending Title 17 of the Louisville Municipal Code to Add a Definition of Extended Stay Lodging
Facility and to Allow Such Facilities in the Commercial-Business (CB) Zone District Subject to a
Special Review Use, seconded by Mayer. All in favor.

Howard moved that Council approve Ordinance No. 1281, Series 1998, An Ordinance Amending
Title 17 of the Louisville Municipal Code to Add a Definition of Extended Stay Lodging Facility and
to Allow Such Facilities in the Commercial-Business (CB) Zone District Subject to a Special Review
Use, seconded by Levihn. Roll call was taken. Motion passed by a 6-0 vote.

9
