COUNCIL COMMUNICATION <br />TO: MAYOR AND CITY COUNCIL <br />FROM: MALCOLM FLEMING, CITY MANAGER <br />DATE: MAY 25, 2010 <br />SUBJECT: UPDATE/DISCUSSION - BUILDING CODE BOARD OF APPEALS <br />(BCBOA) <br />ORIGINATING DEPARTMENT: PLANNING AND BUILDING SAFETY DEPARTMENT <br /> ON BEHALF OF THE BCBOA <br />INTRODUCTION; <br />The Building code Board of Appeals is a six member quasi-judicial board that hears and <br />determines code application and interpretations to specific appeals from homeowners and/or <br />contractors that do not agree with a code ruling via the Chief Building Official. This is a <br />technical board consisting of Architects, Engineers, and Contractors. There is no residency <br />requirement for this board. There has only been one appeal in the last ten years since the <br />current Building Official has been in place. That appeal was brought by State Farm Insurance <br />specific to our 90 MPH fastest mile wind requirement for roofing materials. That case was <br />dismissed due to the fact State Farm was not a home owner or contractor in Louisville. The <br />requirement was upheld for the local wind storms and is currently being required. The Building <br />Code of Appeals also acts as an advisory board to the Building Safety division and the Building <br />Official. The Board plays an important role during code adoption, code amendments, local and <br />state building issues as well as technical support to all areas of construction. <br />BOARD MEMBERS: <br />Chairman: Robert Van Pelt; Vice-Chair: Matt Berry; Members at large: Peter Geise; David <br />Rounds; Gary Mancuso; Alternate Member: Bart Wear; City Liaison/Secretary Michael Jones <br />CBO <br />WORK GOAL FOR 2009: <br />I Adoption of the 2009 International Codes <br />II Update bylaws of the Building Code Board of Appeals to reflect advisory function <br />III Develop a Green Building Program <br />I.
