LUNDBOIL6 <br /> HOWARD S. WJELLAND <br /> Commissioners <br /> COMMISSIONER HENRY E. ZARLENGO DISSENTS <br /> COMMISSIONER HENRY E. ZARLENGO DISSENTING: <br /> I respectfully dissent. <br /> The Applicant is being authorized, inter altar to file to <br /> become effective upon not less than one (1) day's notice on October 23, <br /> 1973" a tariff which provides for increases in retail gas rates of <br /> approximately $5,594,526 annually (1) without hearing; (2) without <br /> evidence of good cause shown for less than thirty (30) days' notice as <br /> required by law; (3) upon a notice which, in addition to its impropriety <br /> because of its reduced period, is not a good, sufficient or reasonable <br /> notice to interested parties; and (4) without good and sufficient <br /> evidence before the Commission to support the authorization of such <br /> increases. <br /> Good and sufficient evidence is not before the Commission <br /> upon which it can be determined whether or not the Applicant can absorb <br /> the increase, or some part thereof, and still retain a fair rate of <br /> return. <br /> To approve such increases under the circumstances to ' offset <br /> increases in wholesale costs to Applicant" destroys incentive on the <br /> part of the Applicant to resist by whatever means possible increases <br /> in wholesale costs and encourages the wholesaler to seek further <br /> increases. <br /> -4- <br />
