Councilman DelPisso suggested that all persons who have constructed their finis on City property be issued the license and from this date, no other fences be allowed on City easements. Councilman Meier stated that he did not feel the license should be issued. Mr. Miller stated that other fences in his neighborhood are on the sidewalk and he thought maybe he could realign some of the posts back so they would be only about 6 inches into the City right-of-way. After discussion Councilman Berry moved that Mr. Miller's application for a license to erect a fence in the utility easement be denied. Seconded by Councilman Meier. Roll call. DiCarlo no Berry yes, Maier yes, DelPizzo no Milker yes, Caranci ( yes. Motion carried to deny the request. DON CHANCE FENCE Mr. Chance stated that he has constructed REQUEST a split rail fence in the front of his home which is on a cul-de-sac on a non- through street, with a 33" set back. He stated that it was a landscape technique. Attorney Joss stated that if Council so chose, to allow the fence to remain a license should be issued. After discussion Councilman Milker moved that the Don Chance fence request be denied. Seconded by Councilman Caranci. Roll call. DelPizzo no, DiCarlo no Berry yes, Milker yes, Caranci yes, Meier yes. Motion carried to deny the fence request. Councilman DiCarlo moved that all licenses for fences which have been issued by the City be revoked and inform the residents involved that the fences have to be re- moved from the right-of-ways and in the future that all fences of that nature will not be issued a permit. Seconded by Councilman DelPizzo. Roll call. DiCarlo yes, Berry no, DelPizzo yes, Milker no, Caranci no, Meier no. Motion defeated.
