Attorney Jose read the FIRST READING ordinance on first reading by title only. Councilman DelPiato moved that Ordinance No 677 be ordered published and a lie hearing be set for March 16, 19410. Seconded by Councilman n Carnival. Notice carried. RESOLUTION NO. 11 Attorney Joss read Resolution No 11, FELLA VISTA SOUTH Series 1980 in full. FINAL PLAT & P.U.D. Mr. Rupp noted that the area was annexed lest year and provisions on the plat have made some improvements to the Roosevelt- Balla Vista Dr. alignment. This is a one acre site to include five lots and one duplex site, and they are requesting one variation on the sot back for the duplex property to site the dup- lex on the lot. Councilman Fauson asked if it is proper to make changes from the preliminary plat to the final without a hearing. It was noted that a public hearing is held when there are changes and for the final plat and P.U.D. ravine. Councilman Caranci questioned the parking. Mr. Pose stated that the parking for the unit will be running parallel to the side- walk and will not overlap the sidewalk. Mr. Wurl stated that there was a modification in the subdivision agreement in the case of the 127, land dedication Mr, Foss will be giving =coy in lieu of. He stated that the agreement provides that the funds will be paid after the third CO is given out. The land will be appraised and the City will receive the amount necessary in lieu of the 12% land dedication. Mr. Rupp stated that they would work the time factor into the agreement. After discussion Councilman Mier moved that Resolution No. 11, Series 1980 be adopted Seconded by Councilman Domenico. Motion carried.
